Mr. Schnelle stated that at the time of Waste Management of Minnesota, /nc.'s request for expansion, Oouncil gave Staff some direction as to the preparation of the findings of fact and requested some further direction regarding these findings of fact proposed to be prepared. Councilmember Schlueter stated that as she recalls it, Council's direction to Staff on the findings of fact for the expansion request was to include all pros and cons to the issue. Councilm~m~er Cox stated that some of the input Staff is looking for is in the Planning and Zoning reoon~mendations; time limitations; consider the fact as it relates to Site P approval; how it allows for utilization of property, if necessary, to provide proper coverage to insure protection; other aspects as it relates to the entire site. Councilmember Cox stated that it should be strongly indicated to those agencies above Ramsey that this is a very important issue; those agencies say they want the opportunity for the City's input; any input the City has given has been misconstrued to make Council look like it's on the wrong end. Councilmember Cox stated he is not limited to taking citizen con~ents at meetings only. Mr. Goodrich stated that one of the facts, in the findings of fact basket, would be that Metro Council and County have not lifted the development moratorium. Mr. Goodrich also noted that this Council can conclude, based on the moratorium fact, to deny the mining Permit request and not go forward until Metro Council and County have addressed the issue. Councilmembers Schlueter and Reimann expressed that all other facts really have no bearing on the decision considering there is a State statute for a moratorium on all development that has not been lifted; the issue is dead. Councilmember Cox pointed out that if an individual, other than Waste Management, owned the property and requested a mining Permit, they would approach the City first. Mr. Goodrich replied that the applicant could come to the City first, but it would be wiser to approach the County and Metro Council first. Mr. Schnelle stated that it would be foolish for the City to move ahead on this before all the 'i's" are dotted and "t's" crossed; the same type of situation exists in the City today for persons owning and wanting to develop property under the jurisdiction of agencies above the City level. Motion by Councilmember Schlueter to disapprove of Waste Management of Minnesota, Inc.'s request for a temporary conditional use permit for mining on the following described property: ~he South Half of the Northeast Quarter of Section 27, Township 32, Range 25, Anoka County, Minnesota. Further Discussion: Mayor Heitman cautioned against disapproving the request prior to adopting findings of fact. City Attorney Goodrich advised February 12, 1985 Page 7 of 16
