CLASSES OF VIOLATIONS <br /> <br />CLASS I <br /> <br />HIGH RISK/ACTUAL DAMAGE VIOLATIONS <br /> <br />Class I violations are those which: <br /> <br />1. Involve a failure to meet a legal requirement to abate an <br /> <br />identified, significant hazard to the environment or to human health; or <br /> <br />2. Present an immediate, direct and serious risk of harm to the <br /> <br />I <br />I <br />! <br /> <br />environment or to human health. <br /> <br />Examples to Class I violations: <br /> <br />1. Failure to comply with a legal requirement to remedy a pollution <br /> <br />source or incident. <br /> <br />Creation of a serious environmental or human health hazard by <br />such as: illegal dumpinq of hazardous wastes, burning toxics <br /> <br />in an <br /> <br />unaporoved boiler or inci.nera~or, or shippinQ wastes to a facilit.¥ not approved <br /> <br />to h:~ndle haz,~rdous waste. <br /> <br />fal,;e information or by refusing to provide information ;,~h'ich the Minnesota <br /> <br />Poll,~tion Control Agency (MPCA) may r,,~quire as !)art oF oq inw~stigation on <br /> <br />I..,.,.,, p,)s :. i!)1.? n~)~lc.)rm)l ian,:e. <br />I <br /> <br /> <br />
