The Company shall allow the Agency or any authorized <br />member, employee or agent thereof, upon presentation of credentials, access at <br />reasonable times to the Company's property and facilities to obtain such <br />information and documentation which is relevant to making a determination that <br />the Company is in compliance with the terms of this Agreement. <br /> <br /> 3. St. ipulated Civil Penalties. <br /> <br /> a. Past Violations of Agency Rules. Within thirty (30) days or the <br /> <br />effective date of this Agreement the Company shall pay into the Environmental <br />Response, Compensation and Compliance Fund of the Treasury of the State of <br />~linnesota the sum of Twenty-Two Thousand Dollars ($22,000) as a civil penalty <br />fur past noncompliance with statutes and rules cited in paragraph A.6. of this <br />Agreement. <br /> <br /> b. Violations of.t. his A~reement. In the event the Company violates <br />a provision or provisions of this Agreement, the Company shall pay into the <br />Environmental Response, Compensation and Compliance Fund of the Treasury of tile <br />State of Minnesota the sum of One Hundred Dollars ($100) for each day that the <br />company fails to comply with the time schedules containe~d in paragraph B.1. of <br />this Agreement. The Company shall not be liable for payment under th~s sub- <br />paragraph if it has submitted to ~he Agency Director a timely request for an <br />extension of time under paragraph 6.f. and such request has been granted. <br /> <br /> Upon determination by the Agency Director that' the Company has failed <br /> to make a submittal or to complete work in accordance with the required time <br /> schedule, the Agency Director shall give written notice to the Company of the <br /> <br /> <br />
