I
!
I
I
!
I
I
I

~S ~ D-2, O~SE t9 Of' QTJNC~ ~ l~'l'~ 8-27-85

~yor and Co~ct2~bers

CiW Ad~i~strator

Alleged hazardous waste violation ~egard~n9 Waltek, Inc.

In reference to the Council meeting of August 13, 1985, I ha~e acoopplished the
following in regards to this alleged violation of Minnesota rules regarding
hazardous waste,

1) I met with the MPCA on Monday, Aigust 26, 1985 to go over their
problem with Waltek regarding the alleged violation of hazardous waste. The
~he following persons were in atte _r_~ance at this meeting:

a) Natalie Haas, District 1 Anoka (bunty Ccmmissioner
b) Assistant Anoka Gounty Attorney
c) Bob Hutchison, Director of Environmental Services, Anoka County
d) Ramon Burk, Representative of Waltek
e} Arnold Cox, Bamsey City Councilmember
f) Ainais Silis, Representative of MPCA, Regulatory __cc~_pliance
Section

I
I

Mr. Sills of MPf~ reviewed with those in attendance the Notice of Violation
that had been issued by the MPCA Regulatory O~mplianoe Section against Waltek.

Enclosure (1) contains a copy of the NotiCe of Violation that was issued
against Waltek. It should be noted that the alleged violation does not cite
them for dumping hazardous waste, but only for improper storage of said
material.

Conclusion - The PCA explained their Notice of Violation against Waltek.
I Waltek stated their position on the issue. The County and City stated that
they wanted to see it resolved but not in the manner that the PCA was
p~oposing. ~he Assistant County Attorney advised Waltek to engage a local law
firm to assist them in resolving the alleged hazardous waste violation.
I However, we keep us on I can see where
did
ask
Waltek
to
informed
this
issue.
we can have other like violators of this same law unless something is done
about it. ~e gove~t creates laws that people want for p~otection and they
Iengage people to enforce these laws, however, how do you get all the people
informed about these laws and the seriousness of th~ if you violate the law.
The natural thing with any law is to place a severe penalty to be levied on
Ithose who violate them and that is the problem here. ! think right now the
Waltek situation will be resolved satisfactorily, but there has already been a
heavy oost involved in this one instance. We are going to have to develop a
better way to keep the s~all business better informed on the laws governing
this issue.

-I iGS:pjc
