I I is something that Council has never done before and they Should understand the potential for someone seeing that signed plat, obtaining a building permit and doing what they want with the land. Mr. Goodrich stated that this action would be an acoon~odation to the developer and added that it is not his intention to allow compromising of the charter requirment that an ordinance does not become effective for 30 days after publication. I I I I I I I i i Mr. Dom stated that the risk involved is that the people oould petition for the ordinance to be put to a referendum and the ordinance oould be defeated; Mr. Dom stated that there has been no oontroversy on this P.U.D. and he does not expect the ordinance to be put to a referendum. Mr. Dorn added that construction cannot begin until the Spring of 1985. Mr. Goodrich stated he is not recon~ending, but Council can grant final plat approval contingent upon the rezoning ordinance becoming finalized. Council consensus was to waive the reading of the proposed resolution. Motion by Councilmember Van Wagner and seconded by Councilmember Reimann to adopt Resolution ~84-240 approving the final plat of the Rum River }{ills Planned Unit Develolm~_nt oontingent on the rezoning of the site to P.U.D. designation. (Please refer to resolution file for Resolution ~84-240). Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, Schlueter and Van Wagner. Voting No: None. Motion by Councilmember Van Wagner and seconded by Councilm~mber Sorteberg to authorize the Mayor to enter into a development agreement with Rum River gills ssociates for the R~n River gills Planned Unity Development contingent upon City Staff approval. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, Schlueter and Van Wagner. Voting No: None. Mr. Goodrich stated he will bring the final draft of the restrictive covenance back to Council for review. I I I Motion by Councilmember Van Wagner and seconded by Councilmer~er Schlueter to acknowledge the introduction of Ordinance ~84-19 regarding the rezoning of the R~ River [~ills P.U.D. site to P.U.D. and Ordinance ~84-Z0 regarding the vacation of White Pines Park and part of }]eli~ Street Nw. Motion carried. Voting Yes: Mayor Gamec, Councilm~rs Sorteberg, Reimann, Schlueter and Van Wagner. Voting NO: None.
