Voting No: None. <br /> <br />Council unanimously oonsented to dispense with the reading of the resolution. <br /> <br />Motion by Councilmember Cox and seconded by counci~r Sorteberg to adopt <br />Resolution {85-10 receiving the feasibility report and setting a public <br />hearing date of Tuesday, April 9, 1985 for River's Bend Second Addition. <br />(Please refer to resolution file for Resolution {85-10). <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, (]ox, <br />Reimann and Schlueter. Voting No: None. <br /> <br />Councilmember Cox inquired as to why there is such a long delay in conducting <br />the public hearing. <br /> <br />Mr. Berg replied that the City Charter requires that the public hearing notice <br />be published in the City Newsletter. <br /> <br />Councilmember Cox stated that this is a situation where delays are costing a <br />lot of money. Councilmember Cox referred to the front page article of <br />January, 1985 Ramsey Resident, where members of council profess to encourage <br />economic development and stated now we have the opportunity for that <br />develoupent and we place all kinds of impositions on the developer. <br /> <br />City Attorney Goodrich stated that an interim newsletter can be published with <br />the hearing notice; the Charter does not limit the number of newsletters to <br />six. <br /> <br />Mayor Beitman stated that fast does not necessarily mean good, but this is one <br />of the reasons he inquired earlier about increasing the frequency of the <br />newsletter. <br /> <br />Councilmember Cox inquired why we should continue to spend more money instead <br />of correcting the problem. <br /> <br />Mayor Heitman inquired if the Charter specified whether or not failure to <br />publish a hearing notice in the newsletter negates it. <br /> <br />Mr. Berg replied that such a statement is not included in this section of the <br />charter. <br /> <br />City Attorney Goodrich stated that he doesn't think the City can abide with <br />the charter and conscientously not publish the hearing notice in the <br />newsletter. <br /> <br />councilmember Cox stated that he thinks this time frame feature was included <br />in the charter as a protection in cases where there is a lot of residents <br />potentially affected; don't think the Charter Commission intended for that <br />feature to affect cases like this and Mr. Battenberg's. <br /> <br />Mayor Heitman stated that he would like the Charter Commission to come up with <br />an alternative to carry the City through these types of situations. <br /> <br />January 22, 1985 <br /> <br />Page 17 of 30 <br /> <br /> <br />
