I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Mr. Don Otter, Mr. Terry Miller and Mr. Edward Moersfelder were present. <br /> <br />Mr. Schnelle stated that a public hearing is not required for a temporary <br />conditional use permit; Council persons in office in 1984 made the decision to <br />conduct a public hearing on this temporary conditional use permit request but <br />this Council must make it's own decision regarding the public hearing; if <br />Council decides to conduct a public hearing they must then set a hearing date. <br /> <br />Reporter Angela Flint requested that Council use their mikes because she was <br />not getting it (on her recorder). <br /> <br />Councilmember COx inquired as to what Reporter Flint is not getting. <br /> <br />Reporter Flint repeated her request that Council use their microphones. <br /> <br />Councilmember COx stated that Ms. Flint could sit between he and Councilmember <br />Sorteberg and then she would get everything and maybe even more than she wants <br />to hear. <br /> <br />Councilmember Schlueter brought up for discussion the development moratorium <br />on landfill buffer area; the fact that she would like to see a public hearing <br />conducted on the permit request and inquired as to Staff's recommendation for <br />a hearing date. <br /> <br />Mr. Schnelle stated that County and State have indicated that the moratorium <br />would be lifted for mining purposes and Staff is recommended that if a public <br />hearing is to be conducted, it be set for February 28, 1985. <br /> <br />Councilmember Schlueter stated that she would like to see something in writing <br />regarding the County and State lifting the develo~mentmoratorium. <br /> <br />Mr. Moersfelder stated that in December of 1984, the decision of that Council, <br />regarding the need for a public hearing, was to forward the matter to the new <br />Council of 1985. Mr. Moersfelder stated that Waste Management of Minnesota, <br />Inc. would like to let this Council know that if they intend to oonduct a <br />public hearing, Waste Management is willing to participate; there were issues <br />raised in December of 1984 by Mr. Douglas Fountain and Councilmember Schlueter <br />that should be addressed. Mr. Moersfelder stated that Waste Management is <br />prepared and willing to proceed with the public hearing as early as February <br />12, 1985. Mr. Moersfelder requested that it be made clear that the public <br />hearing is in regards to a request for a temporary conditional use permit for <br />mining and the hearing is not intended to address all landfill matters. <br /> <br />Mayor Heitman stated that it is an involved issue and he understands that the <br />mining request is separate from landfill operations. Mayor Beitman referred <br />to the December 4, 1984 in which Mr. Otter stated that mining would continue <br />possibly into the year 2005; Mayor Beitman stated that this stretches the <br />imagination of the word 'temporary'. Mayor Heitman asked how the City can <br />separate an extended time period that is directly related to the landfill <br />issue; Council can follow Mr. Moersfelder's suggestion but some serious <br />questions will be asked at the public hearing with respect to the landfill and <br />not to mining. <br /> January 22, 1985 <br /> <br />Page 21 of 30 <br /> <br /> <br />
