Request for a temporary oonditional use permit for mining; case of
Waste Management of Minnesota, Inc.

~he public hearing adjourned at 9:00 p.m. and Council recessed.

Mayor Heitman called the regular meeting back to order at 9:18 p.m.

COUN~TL BOSINESS

~ R~uest For A ~T~rarv COJldit/onal Use Permit For Min/n~:
~ C~se Df i~LaSte Mana~e~ent Of l~esota, Inc.-,

Councilmember Reimann requested that City Attorney Goodrich explain Minnesota
Statute 473.806.

Mr. Goodrich stated that in the siting process in the Waste Management Act of
1980, legislature set up a program whereby any site designated, although not
chosen, and the area within that site, as well as required buffer area, shall
not be developed; this allows for preserving of property within designated
landfill inventory, including Site P, for potential use as a landfill.
mining permit request before the City will require Metro Council and County
permits for that use because of the moratorium. If the City were to grant
this mining permit, it is 100% oontingent upon the applicant receiving
approval from Metro Council and the County for this development. Development
would mean any change in land use from what exists there now.

Councilmember Schlueter inquired if the issuance of this permit is absolutely
essential to complete the capacity of the existing landfill.

Mr. Edward Moersfelder replied that he doesn't know. Completing capacity
at the existing landfill is not the total picture; the operation does not
cease when the last dumping is made at the site. ~e future of the landfill
is determined by factors that Waste Management of Minnesota, Inc. does not
have control over. ~e site may be closed without anything more being done to
it; PCA and County may direct for substantial changes in slope, for instance,
that would require more filling.

Councilmember Schlueter inquired why Waste Management of Minnesota, Inc. did
not approach Metro Council and the County regarding lifting the moratorium
prior to approaching the City for a mining permit.

Mr. Moersfelder stated that during oontract negotiations with Ramsey, Waste
Management of Minnesota, Inc. anticipated getting the mining permit and up
until the sale closing, Waste Management of Minnesota, Inc. was given to
understand that the mining permit would be an administrative matter for
Ramsey. ~e mining permit request was placed, by this Council, on the advice
of City Attorney Goodrich, into the temporary conditional use catecjory. Waste
Management felt it appropriate to pursue the matter with Ramsey; and in
fairness to Metro Council, Waste Management of Minnesota, Inc. wanted to be
able to tell them that one piece of flapping tarp had been pinned down. Waste
Management has tried to provide Ramsey with the best information possible
February 12, 1985
