would be rtifficult to sell those properties to someone if they were to see a parking ramp
assessment on it.

Mayor Gamec asked if the assessments would be proportioned according to use. He expressed
concern that a property such as Coburns would pay the total assessment for the parking ramp, as
they will have their own parking lot. Their shoppers technically would not use that ramp.

Assistant Community Development Director advised against proportioning the assessments. He
indicated it is difficult enough to make sure a benefit is proven without exempting properties
fi'om the assesslnent.

City Attorney Goodrich advised from a legal standpoint benefit does not need to be shown.

Mr. Voss stated development of the other parcels is almost restricted if the assessments are
proportioned because they are overburdened and cannot compete.

Mr. Lasher advised the parking structure was created to ensure the intensity of this development.
With that intensity comes more people and users, which will benefit everyone.

Mr. Feges stated these are all valid points, but it comes down to a business decision regarding the
cost of doing business.

Assistant Community Development Director Trudgeon explained the assessment goes over the
whole Town Center Project. D.R. Horton and the Charter School would have to agree to be
assessed again under this agreement, and to be assessed above and beyond their original
agreement.

Mr. Feges iudicated according to the contract RTC has with D.R. Horton, that assessment is paid
by RTC as the secondary developer. D.R. Horton pays per lot and RTC pays all the expenses.
That is not the case with the Charter School, and that may need to be absorbed in other places.

City Attorney Goodrich advised D.R. Horton and the Charter School will need to sign the escrow
agreement.

Mr. Lasher reviewed item five of the Document.

Councihnember Strommen inquired if the grant money includes the Met Council grant that has
been received.

Mr. Lasher responded in the negative. He explained this refers to future grant money made
available roi' either building additional parking or things such as adding to the park and ride.

Mr. Lasher reviewed item six of the Document.

City Council/June 29, 2004
