would be rtifficult to sell those properties to someone if they were to see a parking ramp <br />assessment on it. <br /> <br />Mayor Gamec asked if the assessments would be proportioned according to use. He expressed <br />concern that a property such as Coburns would pay the total assessment for the parking ramp, as <br />they will have their own parking lot. Their shoppers technically would not use that ramp. <br /> <br />Assistant Community Development Director advised against proportioning the assessments. He <br />indicated it is difficult enough to make sure a benefit is proven without exempting properties <br />fi'om the assesslnent. <br /> <br />City Attorney Goodrich advised from a legal standpoint benefit does not need to be shown. <br /> <br />Mr. Voss stated development of the other parcels is almost restricted if the assessments are <br />proportioned because they are overburdened and cannot compete. <br /> <br />Mr. Lasher advised the parking structure was created to ensure the intensity of this development. <br />With that intensity comes more people and users, which will benefit everyone. <br /> <br />Mr. Feges stated these are all valid points, but it comes down to a business decision regarding the <br />cost of doing business. <br /> <br />Assistant Community Development Director Trudgeon explained the assessment goes over the <br />whole Town Center Project. D.R. Horton and the Charter School would have to agree to be <br />assessed again under this agreement, and to be assessed above and beyond their original <br />agreement. <br /> <br />Mr. Feges iudicated according to the contract RTC has with D.R. Horton, that assessment is paid <br />by RTC as the secondary developer. D.R. Horton pays per lot and RTC pays all the expenses. <br />That is not the case with the Charter School, and that may need to be absorbed in other places. <br /> <br />City Attorney Goodrich advised D.R. Horton and the Charter School will need to sign the escrow <br />agreement. <br /> <br />Mr. Lasher reviewed item five of the Document. <br /> <br />Councihnember Strommen inquired if the grant money includes the Met Council grant that has <br />been received. <br /> <br />Mr. Lasher responded in the negative. He explained this refers to future grant money made <br />available roi' either building additional parking or things such as adding to the park and ride. <br /> <br />Mr. Lasher reviewed item six of the Document. <br /> <br />City Council/June 29, 2004 <br /> Page 5 of 11 <br /> <br /> <br />
