Counci hncmber Elvig asked if tile police will have discretion regarding enforcement and whether <br />warnings would be issued. He also asked if there xvere plans to educate the public about the <br />revised ordinance. <br /> <br />Police Captain Dwyer stated that the Police Department will actively work to educate the public <br />about the revised ordinance and will most likely use some discretion when enforcing the revised <br />ordinance. <br /> <br />Mayor Gamec inquired about the issue of noise created by bands playing after 11:00 p.m. and <br />how that issue will be addressed. In particular, Mayor Gamec stated the City receives noise <br />complaints fi'om residents during City-sponsored events. <br /> <br />City Attorney Goodrich stated that the issue of noise created by bands would be enforced as <br />currently stated in the ordinance. Fie stated that the ordinance could be amended to include <br />permitted uses, e.g., bands that have a permit, and the permit could include a specific time limit, <br />such as 11:00 p.m. during City-sponsored events. <br /> <br />City Attorney Goodrich stated that he would draft language for review by the City Council at its <br />July 27, 2004 meeting that specifically addresses the time limits related to noise during City- <br />sponsored events. <br /> <br />Consensus of the City Council was to direct staff to draft language for incorporation into the <br />proposed Public Nuisance Ordinance xvhich specifically addresses the time limits related to noise <br />during City-sponsored events. The Public Nuisance Ordinance will then be reviewed in its <br />entirety at the July 27, 2004 meeting of the City Council xvith opportunity for public comment at <br />that time. <br /> <br />2) RTC - Development :\gl'content Amendments <br /> <br />City Administrator Norman reported that staff was previously directed to continue work on this, <br />and a meeting is scheduled with the developer this week. He indicated the City Council is not <br />expected to take action and staff is seeking direction at this tilne. <br /> <br />Finance Officer Lund distributed a fiscal impact study outlining projected city tax rates. She <br />stated that currently it is anticipated there will be no debt incmTed in 2005 for the City Hall and <br />Town Center. She also stated thc tax capacity rate represents a very conservative number. <br /> <br />City Administrator Norman advised that grant monies will be available; however, these numbers <br />are not included in thc fiscal impact study. He indicated the remaining issues deal with <br />assessments and escrow and AUAR. City Administrator Norman stated that two small issues <br />remain with respect to the agent position and letter of credit. He stated that if the City <br />Councihnembers have questions, they are encouraged to contact him or Finance Officer Lund. <br /> <br />Councilmember Cook inquired about a Special Tax District and whether the City wanted to have <br />more monies available now via special/tax assessments in order to do improvements. <br /> <br />City C~t~cil \Vork Session/July 13, 2004 <br /> Page 3 of 6 <br /> <br /> <br />
