The
property is generally located in the northwest comer of County Road 56 (Ramsey Blvd.) and
County Road 116 (Industry Blvd.). On October 14, 2003, the City Council approved the first
phase of the development which consisted of 108 townhomes. Town Center Gardens 2'd
Addition contains 40 townhome units.

Community Development Director Frolik stated that Brightkeys is proposing to develop 40
townhome units in their second phase. The units will be located in five, 8-unit buildings. The
units will be "back-to-back" townhomes as contrasted with the "rowhouse" style approved in the
first phase of the development. Landscaping will be provided around the buildings as approved
as part of the site plan approved in 2003. It should be noted that the approved preliminary plat
showed 48 townhome units would be part of the second phase. Brightkeys has decided to
remove one, eight-milt building on the eastern side of the property in order to create a new road
that will serve the land to the north. Brightkeys has submitted a sketch plan that shows the
development of the rest of the parcel with different styles of attached housing. She advised that
the Planning Commission will be reviewing the sketch plan at their August 5, 2004 meeting.

Community Development Director Frolik stated the applicant has submitted grading, drainage,
and utility plans. City Staff has reviewed these documents and has issued a separate review letter
regarding thc plans. A copy of Civil Engineer Linton's July 12, 2004 Review Letter was
distributed to the City Council. She stated that City Staff recommends final plat approval
contingent upon compliance with City Staff Review Letters dated July 9, 2004 and July 12, 2004,
the City Engineer's Review Letter, and the Developer and the City entering into a Development
Agreement.

Motion by Councilmember Cook, seconded by Councilmember Elvig, to adopt Resolution #04-
07-183 to approve the final plat of Town Center Gardens 2nd Addition contingent upon
compliance with City Staff review letters dated July 9, 2004 and July 12, 2004, the City
Engineer's Review Letter and the Developer entering into a Development Agreement with the
City.

Motion carricd. Voting Yes: Mayor Gamec, Councilmembers Cook, Elvig, Pearson, Strommen,
and Zimmerman. Voting No: None. Absent: Councilmember Kurak.

City Council/July 13, 2004
