The City Council, upon receipt of the <br />Planning and Zoning Commission report and <br />recommendation, shall notice and hold a public <br />hearing on the application for tentative <br />development plan approval in accordance with <br />the notice and hearing requirements as set <br />forth in Section XXIV for a zoning change. The <br />City Council shall consider the report and <br />recommendation of the Planning and Zoning <br />Commission, the staff report, and comments and <br />material received at the public hearing and <br />shall either (1) approve the tentative <br />development plan as submitted; (2) approve the <br />tentative development plan subject to specified <br />conditions which may include requirement for a <br />maintenance guarantee and/or a performance <br />luarantee, as may be deemed necessary by the <br />City to assure compliance With such conditions; <br />or (3) deny the tentative development plan as <br />submitted. The City Council shall, in support <br />of its decision, make findings of fact as to <br />the following' <br /> <br />(1) whether the performance standard use <br />conforms with the goals, City Codes, <br />objectives and laud use criteria of the City; <br /> <br />19 <br />21 <br />23 <br />25 <br /> <br />(2) whether the performance standard use <br />conforms in all respects with the <br />performance standards of Section 15A.5; <br /> <br />(3) whether the performance standard use <br />is compatible %'ith adjacent uses and/or <br />with .uses permissible on adjacent sites <br />under existing, zoning; <br /> <br />(~'): whether the performance standard use <br />is adequately served by all necessary <br />~ublic facilities, utilities and City <br />services; <br /> <br />26 <br /> <br />~2 <br /> <br /> <br />
