] <br /> <br />]! <br />) <br />"1 <br />1 <br />] <br />] <br />] <br />] <br />] <br />-] <br /> <br />(4) Housing for Low-Income Families. <br /> <br />(a) <br /> <br />To qualify for a residential density bonus, a project <br />which includes dwelling units for low-income families <br />shall be accompanied by covenant documents or other <br />adequate documents to be recorded with the Office of the <br />County Clerk, guaranteeing the use of those dwelling <br />units for low-income families. The documents shall not <br />be accepted until approved by the City as to legal form <br />and effect, providing that the use restriction be for at <br />least twenty-five (25) years. <br /> <br />(b) <br /> <br />The above requirement may be waived if the dwelling <br />units for low-income families are being provided under a <br />contract with a governmental housing authority which <br />provides adequate assurance that the units will be made <br />available to low-income families for at least twenty- <br />five (25) years. <br /> <br />(c) <br /> <br />No final plan shall be approved for any portion of a <br />planned unit development, approved with a residential <br />density bonus for providing dwelling units for low- <br />income families, until the necessary legal documents <br />have been submitted and approved. <br /> <br />(5) Off-Site Open Space. <br /> <br />(a) <br /> <br />To qualify for a residential density bonus, a project <br />which includes off-site open space shall convey such-- <br />real property to the City in fee simple or be accompa- <br />nied by other adequate documents to be recorded with <br />the Office of the County Clerk, guaranteeing the perma- <br />nent use of the property as open space. The documents <br />shall not be accepted until approved by the City as to. <br />legal form and effect. <br /> <br />(b) <br /> <br />Property qualifying as off-site open space shall be <br />approved for adequacy by the City for its intended <br />use. <br /> <br />(c) <br /> <br />A residential density bonus for off-site open space <br />ar~as shall not be denied solely on the basis of that <br />area being devoted to water channels, water bodies, <br />areas devoted to improved flood channels and areas <br />encumbered by a flowage, floodway, or drainage easement. <br /> <br />(d) <br /> <br />No final plan shall be approved for any portion of a <br />planned unit development approved with a residential <br />density bonus for providing off-site open space until <br />the necessary legal documents have been submitted and <br />approved. <br /> <br />-53- <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br />! <br />I <br />I <br />! <br /> <br /> <br />
