I <br /> I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />i <br />I <br />I <br />I <br />I <br />I <br />i <br />! <br /> <br />Mr. Kmla inquired if the Industrial zone allows for junk yards. <br /> <br />Mayor Heitman authorized City Staff to get information to Mr. Kummala <br />regarding what uses are allowed in an Industrial zone. <br /> <br />Mayor Heitman gave Mr. Kmla his assurance that he will try to enforce the <br />ordinances that are in place. <br /> <br />Mr. Kmla inquired if the ordinance would be enforced if he called to make a <br />formal complaint. <br /> <br />Counc]lmember Cox replied that it would be. <br /> <br />Councilmember Reimann stated that Council is in total agreement on enforcing <br />the ordinance, but it has taken 2-3 years to dispense with some cases and the <br />courts have ruled that the City is harassing people. <br /> <br />Mr. Kmla stated that he is willing to sign a site and design plan, but the <br />City better make sure everybody else is complying also. <br /> <br />Mr. Schnelle replied that the City will do whatever is necessary to enforce <br />it, even taking the property owner to oourt. <br /> <br />Mr. Kummala stated that the City has the power to deny permits for non- <br />compliance. <br /> <br />Mayor Heitman replied that there are certain leverages the City can use to get <br />the property owner headed in the right direction but there are certain <br />implications involved with jeo[~rdizing that person's right to carry on his <br />business. Mayor Heih~an stated that Mr. Kummala has only Council's <br />credibility to go on; the ordinances are there and it is Council's <br />responsibility to enforce them. <br /> <br />Council proceeded to discuss the metes and bounds subdivision requested on <br />this case and Mr. Berg stated that technically, a metes and bounds subdivision <br />does not have to go before Planning and Zoning; Planning and Zoning's <br />recor~endation has been consistently to require platting. <br /> <br />Mr. Kmla stated that he will not spend money on plans until he knows <br />Council view on this case. <br /> <br />Councilmember Schlueter inquired why the developers are not willing to spend <br />money for platting when they are spending $500,000 on the facility. <br /> <br />Mr. A1 Bullock stated that the owners of the property are reluctant to plat <br />because of the excessive cost and low amount of sales in Ramsey. <br /> <br />Councilmember Cox pointed out that the entire 23 acres would not have to be <br />platted out; it could be platted into one lot and one outlot and the oost <br />would not be that great. <br /> <br />Mr. Raatikka stated that the cost of platting into two lots depends on how <br />many variances to platting the City grants. <br /> February 12, 1985 <br /> <br />Page 10 of 16 <br /> <br /> <br />
