<br /> CODE OF THE CITY OF GREENFIELD
<br /> THE CITY COUNCIL OF GREENFIELD
<br /> ORDAINS AS FOLLOWS:
<br /> SECTION 1. Purpose. The put'~se of
<br />I' this ordinance is to create exceptions to
<br />the platting and subdivision requirements
<br />inthe Cityof Greenfield. · ...
<br /> SEC'rION 2. Exceptions.to platting re-
<br />Iquirements. A lot which is part of a'recor-
<br />deal Plat, or a tract which-is:part of a
<br />recorded registered land survey, o~ a par-
<br />cel described by metes and. bounds
<br />Idescriptions, according to the U.S.
<br />Government survey thereof, may be
<br /> ' divided or consolidated into' o.r together
<br /> with another lot, tract, or parcel when the
<br /> following conditions have been met:
<br /> a. The 10.t, tra_c, tor parcel was,.in its pre-'
<br /> !sent 'form., recorded in the office of ~e
<br /> county recorder, or was the subject of a
<br />Iwritten agreement to convey, on the 7th
<br />day of June, 1977.
<br /> : b. The proposed division or consolida-
<br /> tion will not require additional streets.
<br />Ic. If there are any special assessments
<br />against said property arrangements have
<br />i been made to guarantee a fair Share pay-
<br /> iment of any indebtedness for said special
<br /> assessments by the subject lots, tracts, or
<br /> parcels ........
<br /> ~, d. None of the lands involved i~ave
<br /> ipreviously been the subject of a land divi-
<br /> sion under this section.
<br /> e. The proposed division shall result in
<br /> . no more than three lots.

<br /> iSECTION 3. Application. The owner or
<br /> owners of such'lots, tracts, or parcels to
<br /> be SO divided or consolidated.shall file in
<br /> !the office of'the City Clerk ar,. application
<br /> ' for s~!ah division or consolidation toge. ther
<br /> with the following lpformation: · ·
<br /> a. "A: sUrvey..of.'th~i .proposed division
<br /> !showing '.the dimensions of all lands in-
<br /> icluded therein,..the boundaries of said
<br /> lands, the locations of all .buildings: and
<br /> other encroachments, and the location of
<br /> all proposed construction. The City Clerk
<br />
<br /> i may recommend, and the City Council
<br /> may approve, waiver of the survey re-
<br /> qdirement 'in eases where the property
<br /> was previously' platted; where the

<br />ded by the.CitY Engineer, from which it
<br />can be determined that the proposed u~s
<br />of the stibject property are feasible.
<br /> c. A concise legal description of the sub-
<br />ject property before and after the
<br />proposed division or consolidation is com-
<br />pleted.
<br /> d: Dedication and or utility easements,
<br />as recommended by the City .E. ngi?eer.

<br /> SECTION 4. Procedure. Upon receipt
<br />by the City Clerk of the application and re-
<br />quired documents and the payment of an
<br />administrative fee of $ , the City Clerk
<br />shall place the application on the agenda
<br />for the next regular Planning Commission
<br />meeting. The plaun~ng Commission shall
<br />consider the application and shall present
<br />its recommendation for or against ap-
<br />' proval 9!. the application, stating reasons
<br />i therefor.. Approval or. disapproval by the
<br />City Council shall be by resolution, and
<br />resolutions of approval shall be filed in the
<br />office of the County Recorder, Hennepin
<br />County, Minnesota, the fees and other ex-
<br />penses of filing to be paid from the ad-
<br />ministrative fee.
<br /> SECTION 5. Waiver of fees. On ex, ting
<br />plats where .a co~olidation application is
<br />filed in order:.to {orm larger lots than
<br />those originally 'pl~tted, the City Council
<br />may waive all.'0r part Of the ad-
<br />ministrative fee, and the City Clerk need
<br />not collect said !ee before placing the ap-
<br />plication on the Pisn6ing Commission
<br />agenda. '-
<br /> SECTION ~. Additional Fees. In {he'
<br /> e.vent that the City Clerk or the Planning
<br /> Commission, la the exercise of sound dis-
<br /> cretion, finds it necessary to employ the
<br /> services of. City Engineer, City Attorney,
<br /> Planner, Building Inspector, or obtain
<br /> other professional assistance, the cost
<br /> thereof shall be reimbursed to the City by
<br /> the applicant. No building permit shall be
<br /> issued until the resolution of approval, if
<br /> any. is filed and all fees are paid·
