Absent: <br />Commissioner Johnson. <br /> <br />Request For Conditional Use Permit To Mine Fill: Case Of Mr. Bud <br /> <br />The Ccemtission reviewed City Engineer letter dated March 29, 1985. <br /> <br />Mr. Sauter stated that he agrees with the City Engineer's recommendat/on for <br />4:1 slopes and the grading plans will be revised accordingly. Mr. Sauter <br />stated that he feels the City should be approving a grading permit rather than <br />a mining permit as the grading process will improve the property. Mr. Sauter <br />also pointed out that all topsoil will be returned to the property and <br />reseeded. <br /> <br />Commissioner Deener stated that the City will need a performance bond to <br />assure that the property is restored. <br /> <br />Mr. Sauter replied that none of the cuts on the property will be more than 10 <br />feet; that the grading process, without the reseeding he has agreed to do, <br />will leave the property in an improved oondition; reluctant to go along with a <br />performance bond. <br /> <br />Cc~missioner Dee~er replied that the depth of the cut has no bearing on <br />whether or not a performance bond is required. <br /> <br />Chairman Peterson inquired as to how long the grading process will take. <br /> <br />Mr. Sauter replied that the grading would take two to four years. <br /> <br />Ccemissioner ~mer suggested that the applicant take steps to eliminate the <br />build up of dirt and rock that is bound to accumulate at the property acoess <br />on Cty. Rd. #116. <br /> <br />Mr. Sauter stated that he does have a front end loader and would be willing to <br />clean up the property acoess as required. <br /> <br />Motion by Ccem%issioner Zi~merman and seconded by Cxmmtissioner Bendriksen to <br />reooem~_nd adopting Findings of Fact 00 for a conditional use permit to mine <br />fill as requested by Mr. Bud Sauter. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, C(mmtissioners Zin~erman, <br />~er, LaDue, Hendriksen and Johnson. Voting No; None.
