J <br /> <br />J <br />] <br /> <br />] <br />] <br /> .] <br />] <br /> <br />'! <br /> <br />"3 <br /> <br />"3 <br /> <br /> .J <br /> <br />(6) Neighborhood Public Facilities. <br /> <br />(a) To qualify for a residential bonus, a project which <br /> includes neighborhood public facilities beyond those <br /> otherwise required by the City, shall be accompanied by <br /> an agreement to be recorded with the Office of the <br /> County Clerk, guaranteeing the construction of those <br /> facilities in a timely manner acceptable to the City. <br /> The documents shall not be accepted until approved by <br /> the City as to legal form and effect. <br /> <br />(b) The types of neighborhood public facilities that would <br /> qualify a project for a residential density bonus <br /> include, but are not limited to: <br /> <br />[1] Dedication of public park land; <br /> <br />[2] Expansion of Transfort service; <br /> <br />[3] Extension or augmentation to City utilities, <br /> including water, sewer, electricity, storm drain- <br /> age, pedestrian walks/bikeways/streets; and <br /> <br />[4] Dedication of land for public use, including <br /> libr.ary, fire station, police station or other City <br /> facilities. <br /> <br />(c) Neighborhood public facilities qualifying for a resi- <br /> dential density bonus shall meet the following require- <br /> ment s: <br /> <br />[1] Must be for the use and enjoyment of the residents <br /> of the project and/or surrounding neighborhood; <br /> and <br /> <br />[2] Must be approved by the City. <br /> <br />(d) No final plan shall be approved for any portion of a <br /> planned unit development, approved with a residential <br /> density bonus for providing neighborhood public facili- <br /> ties until the necessary legal documents have been <br /> submitted and approved. <br /> <br />K. Variance Procedures <br /> <br />The Planning and Zoning Board is empowered to grant variances to <br />the provisions of this section under the following circumstances: <br /> <br />-54- <br /> <br /> <br />
