Mr. <br />Goodrich noted that the bonding amount on permits can vary. <br /> <br />Oouncilmsmber Cox referred to Mr. Sauter's ctm~ent regarding going for a <br />grading permit through the platting process and suggested that Mr. Sauter <br />explore all aspects and ramifications before making a decision to do so. <br /> <br />Mr. Berg stated that the City does not have an ordinance controlling mining; <br />control is through Chapter 70 of the Uniform Building Code - 'Excavating and <br />Grading'. Mr. Berg also stated that the word 'mining' is a misuse of terms. <br /> <br />Mr. Goodrich pointed out that all grading permits, whether they are obtained <br />through the platting process or grading permit application prooess, require an <br />agreement and bonding. <br /> <br />Mr. Berg stated that some of the exceptions to requiring a grading and <br />excavating permit listed in the Building Code are as follows: excavations for <br />buildings, c~neteries, refuse disposal sites, wells or tunnel, cuts or fill <br />less than 2 feet. <br /> <br />Oouncil consensus is to strike the term 'mining' from the agreement and <br />substitute it with 'excavating and grading'. <br /> <br />Mayor Heitman inquired if Mr. Sauter has a lahasing and restoration plan. <br /> <br />Mr. Sauter stated that a plan was sukmitted to Planning and Zoning. <br /> <br />Mr. Raatikka stated that the plan does not show l~hasing or sequence in which <br />site will be graded and restored. <br /> <br />Mr. Sauter stated that he does not agree with It~ %5 in the proposed <br />agreement; replacing of topsoil is necessary for his operation to proceed and <br />doesn't understand why it would be necessary for the City to inspect each <br />tract before he progresses onto the next. <br /> <br />Mr. Berg stated that a tract does not have to be 100% oomplete, but the City <br />should have the right to make sure that a good percentage of the restoration <br />is complete before Mr. Sauter moves onto the next tract. <br /> <br />Mr. Raatikka noted that Mr. Sauter will be working on two tracts (10 acres) <br />simultaneously, stripping frc~ one and applying the fill to another. <br /> <br />Council consensus is to amend Ite~ %5 of the proposed agreement restricting <br />the grading operation to not more than 10 acres at one time without <br />restoration having been accomplished and to notify City Staff accordingly. <br /> <br />Mr. Sauter referred to Ite~ %6 of the proposed agreement and stated that a <br />$5,000 performance bond should be sufficient. <br /> <br />Oouncil oonsensus is to amend It~ %6 of the proposed agreement to set the <br />performance bond amount at $7,500. <br /> <br />May 14, 1985 <br /> <br />Page 7 of 20 <br /> <br /> <br />
