170.0318 YARIAI,{CE S <br /> <br />170.0318A BARDSHIP <br /> <br />The City Council may adopt a resolution to grant a variance from the <br />requirements o[ this chapter as to specific tracts of land where it is shoma <br />that by reason of topography or other physical conditions, strict compliance <br />vith these requirements could cause an exceptional and undue hardship to the <br />enjoyment of a substantial property right, provided that a variance may be <br />sranted only if the variance does not adversely affect the apirit and intent of <br />this chapter. <br /> <br />170.0318B PROCEDURE <br /> <br />Written application for a variance shall be filed vith the Zoning Officer on <br />forms supply by the City and shall state fully all facts relied upon by the <br />applicant. The application shall be supplemented vlth ~aps, plans or other data <br />which nmy aid in an analysis of the ~atter. The application aha11 be referred <br />to the Planning Co~miasiou for its recommendation and vritteu report to the City <br />Council for its final action. A fee shall be charged for variance applications <br />as set by City Council resolution. <br /> <br />170.0318C CITY COUNCIL ACTION <br /> <br />! <br />! <br /> <br />No variance aha11 be granted by the City Council unless it shall have received <br />the ~aJority vote of the Council. The City Council shall make vritten findings <br />and conclusions of its action on the variance application, ~hich findings and <br />conclusions shall be recorded in the Council's official ~inutes. <br /> <br /> <br />
