The City council may amend this chapter as proposed by a member <br />of the City Council, Planning Commission, or by a petition of a <br />person residing or owning property within the City of Ramsey, in <br />accordance with the foil(ming provisions. <br /> <br />Type of amendments: <br /> a. Change in district's boundary; <br /> b. Change in district's regulations; <br /> c. Change in any other lxovision of this ordinance. <br /> <br />Required exhibits: <br /> a. Boundary line s~wey; <br /> b. General develolm~nt plan showing potential develol~ent <br /> of the property, indicating proposed streets, <br /> buildings, drainage, and landscaping; <br /> c. Other information as required by staff. <br /> <br />Procedure <br /> <br />Petitions for amendment shall be filed with the Planning <br />Commission and the petitioner, upon such filing, shall pay an <br />advertising deposit and a filing fee in accordance with a <br />schedule annually affi~d by resolution. The Planning Commission <br />shall review the proposed amendment and report its findings and <br />recommendations in writing to the City Council and to the <br />petitioner. The proposed amendment shall be introduced before <br />the City Gouncil only if a member of the City Council elects to <br />do so. If an amendment proposed by petition is not introduced, <br />the advertising deposit shall be refunded to the petitioner; <br />otherwise such deposit shall be paid to the City. <br /> <br />Any proposed amendment introduced by a member of the Planning <br />Cx~mission without written findings and recommendations from the <br />Planning C~r~ission shall be referred to the Planning Commission <br />for review at least 30 days prior to public hearing by the City <br />Gouncil. The City Council may not act upon the proposed <br />amendment until 60 days have elapsed from the date of reference <br />of the amendment without a report from the Planning C~m~ission. <br /> <br />Before voting on the enactment of an amendment, the Planning <br />Commission shall hold a public hearing thereon, pursuant to <br />public notice. It shall be the responsibility of the zoning <br />officer to have notice of the time, place, and purpose of the <br />public hearing published in the official city newspaper prior to <br />the hearing. Also, when an amendment involves changes in district <br />boundaries affecting an area of five acres or less, a written <br />notice of the hearing stating its time, place, and purpose shall <br />be mailed by the zoning officer at least ten days prior to the <br />day of the hearing to each owner of affected property and <br />property situated wholly or partly within 350 feet of the <br />property to which the amendment relates.
