CASE # 3 <br />REQUEST FOR A VARIANCE FROM FLOOR AREA lcL4.TIO REQUIREMENTS IN <br />THE TC-2 COMMERCIAL ZONING DISTRICT; CASE OF RANIDANCE LLC <br /> By: Patrick Trudgeon, AICP, Assistant Community Development Director <br /> <br />Background: <br /> <br />Ramdance LLC is proposing to develop Outlot I of Ramsey Town Center. Lot 1 will contain a <br />54,000 square ibot grocery store, a 2,000 square foot car wash/gas canopy, and 371000 square <br />feet of retail stores for a total of 93,000 square feet of building. The property is located in the <br />TC-2 Commercial Zoning District which requires a Floor Area Ratio '(F.A.R.) o£ 0.50. Lot 1 is <br />only showing a F.A.R. of 0.24. The Planning Commission and City Council reviewed the site <br />plans ~br most of the buildings contained on Lot 1 and have approved the preliminary Site plan <br />contingent on Ramdance receiving a variance to the F.A.R. requirement in the TC-2 Commercial <br />Zoning District as well as receiving a variance to allow for more than one principal building on a <br />lot. The variance to multiple buildings on One lot will also be considered bY the Board of <br />Adjustment on August 5, 2004: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map. <br />Site Plan <br />Draft Board of Adjustment Meeting Minutes dated July 12, 2004 <br />Proposed resolution to adopt findings of fact <br />Proposed variance resolution <br /> <br />Observations: <br /> <br />The subject property is zoned TC-2 Town Center Commercial. Section 9.20.25 (3) (b) of City <br />Code establishes a minimum Floor Area Ratio (F.A.R.) of 0.50. The F.A.R. was included in the <br />TC-2 Commercial Zoning District to require a certain amount of building coverage in the Town <br />Center in order to maximize development. The Town Center Development Guidelines for the <br />TC-2 Commercial Zoning District encourages large scale retail. Given the need for areas of <br />parking as well as stormwater management regulations, a large percentage of the lot in the TC-2 <br />District will be utilized for non-building uses. Staff will be exploring the possibility of lowering <br />the F.A.R. requirement in the 'TC-2 Commercial Zoning District. However, the Board of <br />Adjustment/Planning Commission indicated that they would prefer to process a variance at this <br />time tbr the present development and look at amending the F.A.R. requirement at a later date. <br /> <br />The sketch plan for the development of the grocery store' that was approved by the Planning <br />Commission on May 6 and the City Council on May 11, 2004 showed the layout under <br />consideration. <br /> <br />Recmnmendation: <br /> <br />City Staff; recommends approval of the variance. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #04-08- adopting Findings of Fact #__ relating to a request <br />fi'om Ramctal~ce LLC for a variance to the F.A.R requirement in the TC-2 Commercial Zoning <br />District. <br /> <br />17 <br /> <br /> <br />
