Board Member introduced the following resolution and moved for its adoption: RESOLUTION #04-08- A RESOLUTION APPROVING THE ISSUANCE OF'A VARIANCE AND DECLARING TERMS OF SAME. WHEREAS, RAMDANCE LLC, hereinafter referred to as ~'Applicant,'' has properly applied for a variance from Section 9.20.25(3)(b) regarding minimum Floor Area Ratio (F.A.R.) requirements in the TC-2 Commercial Zoning District, on the property legally described as Ibllows: Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject Property); and WHEREAS, the Board of Adjustment met on August 5, 2004, conducted the public hearing and adopted findings of fact relating to the request for a variance t}om the Floor Area Requirement in the TC-2 Commercial Zoning District as part of the development of the Subject Property. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows Based on Resolution #04-08-__adopting Findings of Fact ii , a variance to the minimum Floor Area Ratio in the TC-2 Commercial Zoning District, as established in Section 9.20.25(3)(b) of the Ramsey City Code, is approved tbr the development of a groce~ store on the Subject Property. That the Applicant is allowed to have a Floor Area Ratio of 0.24 on the future Lot 1, Block 1, Ramsey Town Center 3rd Addition. The development of Lot 1, Block 1, Ramsey Town Center 3rd Addition shall generally be in accordance with the Preliminmy Site Plan prepared by URS dated July 8, 2004 and as amended in the future. The Pennittee shall be responsible for all City costs incurred in processing the variance request.
