Associate Planner Wald replied there would be eight feet of berm with'landscaping on top. This
does not meet the MPCA decibel standard, but the Council approved a wall that did not meet the
standard either.

Councilmember Elvig stated he would prefer the ben'n with plantings as opposed to the wall.

Councilmember Cook concurred.

Mayor Gamec noted one of the reasons they looked at breaking the wall up was so that it would
not be one big wall.

The consensus of the City Council was to approve the proposed berm and landscaping.

Councihnember Cook noted the setbacks are ~eater with this plan.

Councilmember Strommen inquired if the landscaping could be intensified in the area where the
units are closest to Highway 10.

Associate Planner Wald replied the landscaping plan is extremely dense in that area already.

Motion by Councilmember pearson, seconded by Councilmember Cook, to adopt Resolution
#04-06-148 to approve the preliminary plat of Rivenwick 4"' Addition noting the approved
deviations and contingent upon compliance with City Staff Review Letter dated June 4, 2004,
and to approve the site plan of Rivenwick 4th Addition noting the approved deviations and
contingent upon compliance with City Staff Review Letter dated June 4, 2004.

Councihnember Zimmerman asked if the fire code for the condos and townhouses would apply
with this development.

Associate Planner Wald replied that has not been determined at this point. It will be addressed in
discussions with the fire ordinance and does not apply to this discussion. The developer is
asking to be exempt from the requirements and their request will be discussed during the
discussion of the fire sprinkler ordinance, which will be back on the table in two weeks.

Councilmember Kurak asked if the fire sprinklers would be required of the developer at this
time.

Associate Planner Wald replied as of now the requirements are not effective, however, if it is
based on a building permit this development would be subject based on the building permit. The
requirements are not based on platting, but are based on a building permit.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Pearson, Cook, Elvig, Kurak,
Strommen, and Zimmemqan.

Case #1I:

Request for Final Plat Approval of Rivenwick Village; Case of Turtle Moon
Inc. and Ryland Homes

Ci~ Council/June 8, 2004

P61
