Case #4: public Hearing Request for Vacation of Easement; Case of Turtle Moon Inc. <br />Mayor Gamec closed the regular portion of the City Council meeting at 7:27 p.m. in order to <br />conduct a pub{lc hearing. <br /> <br />Public Hearing <br /> <br />Mayor Gamec called the public hearing to order at 7:27 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik explained the City Council recently ~anted final plat <br />approval to Rivenwick Village, a mixed use planned unit development consisting of 140 <br />dwelling units in the southeast quadrant of Highway #10 and Riverdale Drive NW. The <br />underlying outlot that makes up the plat contains a drainage and utility easement for a ponding <br />area. That ponding area is being reconfigured with the plat of Rivenwick Village. Therefore, the <br />existing draim!ge and utility easement must be vacated and. replaced with the new easement as <br />shown on the final plat of Rivenwick Village. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Strommen, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Strormnen, Cook, Kurak, <br />Pearson, and Zimmennan. Voting No: None. <br /> <br />The public hearing closed at 7:28 p.m. <br /> <br />Council Business <br /> <br />Mayor Gamec called the regular City Council meeting back to order at 7:28 p.m. <br /> <br />Councilmember Kurak inquired if the placement of the easement and the new ponding will be a <br />problem with the clean up in the area. <br /> <br />Community Development Director Frolik replied a thorough review of this was completed by the <br />Engineering Department. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Kurak, to introduc~ an ordinance <br />to vacate the drainage and utility easement in Outlot A, Rivenwick 3rd Addition. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Kurak, Elvig, Pearson, <br />Strommen, and Zimmennan.
