CASE #

PUBLIC HEARING REGARDING REQUEST FOR AN AMENDED CONDITIONAL
USE PER3/IIT TO ALLOW FOR EXPANSIONS OF THE GREEN VALLEY
GREENHOUSE IN THE R-1 RESIDENTIAL DISTRICT;.
CASE OF JOHN ROWE
By: Community DeveloPment Director' Sylvia Frolik

Background:

In 1977, Wayne Davis established the Green Valley Greenhouse on his homestead at 6530 Green
Valley Road. In 1990, Mr. Davis determined that an expansion of his warehouse would be
necessary. The subject property is zoned R-1 Residential and agriculture is a permitted use in
that zone. However, the City Code definition of agricultural uses includes flower nurseries, but
without buildings. Therefore, Mr. Davis' operation was determined lawful, non-conforming and
it was necessary fbr the City to issue a Conditional Use Permit to allow the expansion of the
greenhouse operations. That permit stated that any future expansions or additions of permanent
structures to the facility would require amendments to the conditional use permit. In 2000, the
City issued an amended CUP to Mr. Davis to allow for approximately 18,000 square feet' of
expansions to the greenhouse facility.

The following items are enclosed for your information:

ao

Site location map
Site plan submitted by Applicant, dated July 8, 2004, identifying existing facility
and potential growth areas that allows for a 65 foot buffer yard on all site
boundaries.
Aerial photo of site, modified by City Engineering Department to identify existing
facilities and a potential 167,720 square foot growth area along the south property
line that will meet a 65 foot setback.
Proposed findings of fact
Proposed conditional use permit

Notification:

In accordance with State Statute, City Staff attempted to notify all owners of property within 350
feet of the Subject Property or the request and public hearing.

Observations:

In 2004, Mr. Davis sold the greenhouse business to his brother-in-law, John Rowe. Mr. Rowe
approached the City with a request to expand the greenhouse operations. After reviewing his
future plans ~:br the property, City Staff' recommended that Mr. Rowe apply for an amended CUP
that would establish a maximum cap to the size of the operation. It is staff's opinion that
operating under a building coverage cap is more efficient than processing a CUP every time
there is a need to expand some aspect of the greenhouse facility.

43
