Counciln~ber Cox stabed that ~e were 5 ai~t~es ~ ~e ~on for ~ <br />i~e~i~on ~ 5 ~c~r~ ~ ~e ~cision ~ a~e ~e <br />i~e~i~on; ~e $500 ~e~~ ~ ~d ~ ~vi~ ~ly ~ <br />~o~ 10 ~r~. <br /> <br />Mr. Fountain stated that if the cost is divided the way O~uncil~ber Oox <br />suggests, he will withdr~ his contribution. <br /> <br />Motion by Councilm~nber Gox and seoonded by Councilm~ber Reimann that the cost <br />of the special investigation ($500) be divided equally m~ong the 5 petitioners <br />and the 5 ~ouncilpersons. <br /> <br />Further Discussion: Mayor Heitman inquired as to l~w this motion could be <br />enforced. Mr. Schnelle stated that the City does have the funds to cover the <br />cost of the investigation; if these 10 people pay the oost, it would be a <br />voluntary action. G~uncilmem~er Schlueter stated that the oost ~f the <br />investigation would be taken out of the City's General funds, which is taxpayer <br />dollars, to which she has contributed her fair share. Councilm~nber COx noted <br />that there are taxpayers that did not want to pray for the investigation that <br />would be paying for it through the City's General Fund. <br /> <br />Motion ~rried. Voting Yes: Mayor Hei~an, O~uncilm~bers Sorteberg, Cox and <br />Reimann. Voting No: Councilm~nber Schlueter. <br /> <br />Regu_ est For Conditional Use Permit For B0me Otc _upation~ ~e Of Mr. <br /> <br />Mr. Schnelle stated that Mr. Ness is requesting a conditional use permit to <br />operate a b~me improv~ent business fr~ bis residence; the City h~ never <br />granted a permit for this type of use before. <br /> <br />Mr. Ness stated that there will be no advertising sign Blaced on his property. <br /> <br />Mayor Hei~m~an inquired if the permit would be transferrable to future property <br />owners. <br /> <br />Mr. Goodrich replied that State statute will not allow a City to deny <br />transferring a conditional use permit to ensuing property owners. <br /> <br />Motion by Councilm~mber Reimann to adopt the Findings of Fact 0119 for Mr. <br />Donald Ness' request for a conditional use permit for a h~me occupation. <br />Please refer to findings of fact file for Findings of Fact 0119. <br /> <br />Further Discussion'. Mr. Goodrich stated that City Council has to adopt a <br />findings of fact consistent with what Council's decision will be. <br /> <br />Councilms~ber Reimann withdrew bis motion to adopt the findings of fact and <br />Council pro~ccded to review and amend the findings. <br /> <br />Mr. Ness stated that he is a subcontractor and his jobs come to kim by Dhone; <br />he has no ~.pl~yees that would be o~ing to bis ~x~e and the accessory <br /> August 97, 1985 <br /> <br />Page 20 of 28 <br /> <br /> <br />
