Goodrich - City Attorney <br />I Re: Waste Management of Minnesota Inc.'s <br /> Date: November 20, 1984 <br /> <br />Mining Permit <br /> <br />I As you were advised at your November 13, 1984, meeting, Waste <br /> Management of Minnesota, Inc. has applied for a mining permit to <br />i extract approximately 785,000 cubic yards of material from the <br /> South 1/2 of the Northeast 1/4 of Section 27, Township 32, Range <br /> 25. We sometimes refer to this as the "Trico" property. <br /> <br /> I <br />I <br />I <br />I <br /> <br /> At your Council meeting on November 13, 1984, we briefly <br />discussed this subject and it was determined that the <br />application should be referred to the Planning Commission and <br />the City Engineer for review. <br /> <br /> After further review of the City's Zoning Ordinance and <br />consultation with Charles Lefever, I am of the opinion that this <br />matter can be treated as an application for a Temporary <br />Conditional Use Permit. The major procedural difference <br />between a Conditional Use Permit and a Temporary Conditional Use <br />Permit is that a Temporary Use Permit does not require a public <br />hearing. <br /> <br /> Although a public hearing before the Planning and Zoning <br />Commission is not legally required, if you desire public input <br />on this subject, it is lawful for the Council to schedule a <br />public hearing prior to consideration of the permit. <br /> <br /> I have also written to the Environmental Quality Board for <br />an opinlon from them as to whether or not an Environmental <br />Assessment Worksheet (EAW) is mandatory for this project. As of <br />this date I have not received the EQB's response. <br /> <br /> The City Staff will request the Planning Commission to make <br />recommendations to the Council as to what conditions might be <br />appropriate in the granting of a Temporary Conditional Use <br />Permit of this nature. The Planning Commission will review this <br />subject at their December 4, 1984 meeting. <br /> <br /> <br />
