Goodrich - City Attorney I Re: Waste Management of Minnesota Inc.'s Date: November 20, 1984 Mining Permit I As you were advised at your November 13, 1984, meeting, Waste Management of Minnesota, Inc. has applied for a mining permit to i extract approximately 785,000 cubic yards of material from the South 1/2 of the Northeast 1/4 of Section 27, Township 32, Range 25. We sometimes refer to this as the "Trico" property. I I I I At your Council meeting on November 13, 1984, we briefly discussed this subject and it was determined that the application should be referred to the Planning Commission and the City Engineer for review. After further review of the City's Zoning Ordinance and consultation with Charles Lefever, I am of the opinion that this matter can be treated as an application for a Temporary Conditional Use Permit. The major procedural difference between a Conditional Use Permit and a Temporary Conditional Use Permit is that a Temporary Use Permit does not require a public hearing. Although a public hearing before the Planning and Zoning Commission is not legally required, if you desire public input on this subject, it is lawful for the Council to schedule a public hearing prior to consideration of the permit. I have also written to the Environmental Quality Board for an opinlon from them as to whether or not an Environmental Assessment Worksheet (EAW) is mandatory for this project. As of this date I have not received the EQB's response. The City Staff will request the Planning Commission to make recommendations to the Council as to what conditions might be appropriate in the granting of a Temporary Conditional Use Permit of this nature. The Planning Commission will review this subject at their December 4, 1984 meeting.
