Voting No: None. <br /> <br />b) Final Approval Of Rum River Mills P.U.D. - <br /> <br />Mr. Dom was present. <br /> <br />Motion by Councilme~r Van Wagner and seconded by Councilm~r Schlueter to <br />adopt Findings of Fact 009~ for the final approval of the Ru~ River Mills <br />Planned Uni~ Develol~ent. (Please refer to findings of fact file for Findings <br />of Fact 009~). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilm~rs Sorteberg, Reimann, <br />Schlueter and Van Wagner. Voting No: None. <br /> <br />Council proceeded to review the proposed development agreement. <br /> <br />City Attorney Goodrich stated that Council has given preliminary approval to <br />this P.U.D. Public improvements include construction of streets, 169th Avenue <br />~ and Iodine Street N~, in accordance with the City of Ramsey; developer is <br />required to submit to the City escrow and guarantee street construction. <br />Developer has petitioned for bonds for local improvements and Council will not <br />be acting on that tonight ~-- that issue will proceed on it's own merits and is <br />a separate process. ~Inere is no park land dedication fee; Council agreed that <br />the proposed plat contains over 100 acres of land to be utilized as golf <br />course and the fee was waived. Developer is asking that existing park, White <br />Pines, be vacated to become a part of the golf course. Developer is asking <br />that a small section of dedicated street also be vacated. Ordinances are <br />being introduced tonight for the rezoning to P.U.D. and vacation of park and <br />street section. Outlots on the northern 1/2 would be conveyed from the <br />developer to the City and the City in turn, is being asked to convey that <br />property to Wes Bulen's group which is-constructing the golf course. When the <br />developer conveys to the City those outlots, he will be observing an easement <br />such that homes will have future right to ~se golf course fairway in the event <br />of septic system failure. When property is conveyed to Bulen's group from the <br />City, by ordinance, the City will retain a reservation on that conveyance such <br />that the golf course will remain a public golf course at all times; we have <br />asked for a restriction that the golfing cost charged be no greater than <br />average golfing costs metro wide. Golf course developer will be p~oposing an <br />alternative to cash payment for White Pines; Council will not be addressing <br />that tonight but it is addressed in the development agreement. Develo~m~ent <br />agreement also provides for restrictive covenance and some additional items <br />the City would like addressed in that covenance is fences and grooming of <br />entire yards, junk cars, outside storage, home size (1200 sq. ft. minim~ <br />excluding basements, porches and garages), accessory buildings. Mr. Goodrich <br /> stated that the developers have certain needs, tax wise, to have the plat <br /> recorded by December 31, 1984. me City is not able to say ~hat the plat is <br /> finalized because the ordinance cannot be adopted ~ntil the second Council <br /> meeting in December and then the ordinances does not become effective until 30 <br /> days after publication. ~he developer is asking for some device to allow him <br /> to have the plat filed but have it restricted so that no building permits be <br /> issued until the zoning ordinance is effective.
