Coun¢i lmembe r <br />adoption: <br /> <br />introduced the following resolution and move~]~for its <br /> <br /> RESOLUTION ~85- ~_~;~ ~i <br /> <br />RESC~TION ESTABLISHING CONSTRUCTION, FINANCING, CONNECTION AND ASSESSMENT <br />POLICIES ON STREETS AND UTILITIES <br /> <br />WHEREAS, the City of Ramsey became a (]narter City in 1984; and <br /> <br /> WHEREAS, the adopted Charter of the City of Ramsey required the <br />Council to enact suitable ordinances governing local improvements and special <br />assessments; and <br /> <br /> WHEREAS, the City Council repealed Ordinances %83-5 and %83-14 and <br />adopted Ordinance %84-8 to comply with the Home Rule Clnarter; and <br /> <br /> WHEREAS, Ordinance %84-8 provides for the procedure for initiating, <br />constructing, maintaining, and financing local improv~ents and the imposition <br />of special assessments; and <br /> <br /> WHEREAS, Section 210.01.10 of Ordinance %84-8 requires the Clerk, <br />with t/ne assistance of the Engineer or other qualified person selected by the <br />Council to calculate the property amount to be specially assessed for the <br />improvament against every assessable lot, piece or parcel of land. <br /> <br />NCI4 ~lqEREFORE, BE IT RESOLVED BY TgE CITY CCI3NCIL OF 9~qR CITY OF RAMSEY, ANOKA <br />CCIJNTY, STATE OF MINNESCYlI~, as follows: ._ <br /> <br /> 1) ~he following guidelines and policies shall be used in constructing, <br />assessing, financing, and connecting to public improvements in the City of <br />Ramsey, so as to assure uniform and consistent treatment to the various <br />properties from year to year: <br /> <br />A) <br /> <br />General Assessment Policy - It is the policy of the City of <br />Ramsey that all properties shall pay their fair share of the cost <br />of local improv~ents as they benefit; it is not intended that <br />any property shall receive the benefits of improvements without <br />paying for tham. Local improvaments will include water, sanitary <br />sewer, streets, storm drainage, sidewalks, street lighting, <br />recreational facilities, etc. <br /> <br />I <br />i <br />I <br />I <br />I <br />I <br /> <br />B) Policies Relating to Special Assessments: <br /> <br />(1) <br /> <br />Assessments - The total of assessments cannot exceed the <br />project cost and must be apportioned equally within <br />properties having the same general land use (residential and <br />institutional, multiple family and commercial, or <br />industrial) based on benefit. Total assessment against any <br />particular parcel shall not exceed benefit to that parcel. <br />Project cost may include part or all of cost of previously <br />installed projects not previously assessed. <br /> <br />(2) <br /> <br />Assessment Period - Improvements installed as a part of a <br />new residential subdivision and petitioned for by the <br />Developer shall be assessed for a period of five (5) years. <br />New commercial and industrial subdivisions petitioned for by <br />the Developer shall be assessed for a period of ten (10) <br /> <br /> <br />
