I <br /> I <br />'1 <br /> I <br /> ! <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />thirty (30) days, the notice of non-approval <br />shall become final. <br /> <br />(a) '~e hearin9 will be held in an ap- <br />propriate local community within sixty <br />(60) days of the demand and after at <br />least two (2) w~eks published notioe. <br /> <br />(b) The hearing will be conducted in ac- <br />cordance with Minnesota Statutes 105.44, <br />Subdivision5 and 6 (1971) as amended. <br /> <br />(c) The Op~missioner shall either certify <br />his approval or disapproval of the <br />proposed action within thirty (30) days <br />of the hearing. <br /> <br />e) The following recreational uses shall <br />require certification approval by the Com- <br />missioner: <br /> <br />(i) Coverrm~ental campgrounds <br /> <br />(ii) Private campgrounds <br /> <br />(iii) Public accesses, road access type <br />with boat launching facilities <br /> <br />(iv) Public accesses, trail access type <br /> <br />(v) Tmporary docks <br /> <br />(vi) Other goverr~ental open space <br />recreational uses <br /> <br />4) Enfor om~ent <br /> <br />a) It is declared and unlawful for any person to <br />violate any of the terms and provisions of this <br />ordinance. Violation thereof shall be a misde- <br />meanor. Each day that a violation is permitted <br />to exist shall constitute a separate offense. <br /> <br />b) In the event of a violation or a threatened <br />violation of this ordinance, Ramsey or the Com- <br />missioner of Natural Resources, in addition to <br />other r~nedies, may institute appropriate actions <br />or procccdings to prevent, restrain, or abate such <br />violations or threatened violations. <br /> <br />c) Any taxpayer or taxpayers of Ramsey may insti- <br />tutemandamasproceedings in the District Court to <br />compel specificperformance by the proper official <br /> Ordinance J85-2 <br /> <br />- 36 - <br /> <br /> <br />
