WHEREAS, the entire P.U.D. shall be subject to restrictive <br />oovenants and conditions in order to maintain the appearance of <br />the develoFment. <br /> <br />NOW ~EREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKACOUNTY, STATE OFMINNESOTA, as follows: <br /> <br /> 1) That preliminary approval of the West Oaks Planned Unit <br />DeveloFment is hereby granted. <br /> <br /> 2) That final approval of the West Oaks Planned Unit <br />DeveloFment is hereby granted subject to the following: <br /> <br />a) <br /> <br />That North Fork, Inc. and the City enter into a <br />comprehensive develoFment agreement which agree- <br />ment shall incorporate all City Code requirements <br />and City policies relating to a development of <br />this nature; and <br /> <br />b) <br /> <br />That the Applicant comply with each item contained <br />the City Engineer's letter dated June 5, 1985 <br />and addressed to the Mayor and City Council; and <br /> <br />c) <br /> <br />That there be an agresment between the Applicant and <br />the Cityof Elk River for the financial responsibility <br />relating to Ramsey's share of the improvement of <br />Jarvis Street adjacenttothe subject plat; and <br /> <br />d) <br /> <br />That the City of Ramsey receives a proper legal <br />description of the subject property as approved <br />by the City Attorney; and <br /> <br />e) That the West Oaks Planned Unit Development site <br /> be rezoned to P.U.D.; and <br /> <br />f) <br /> <br />That the City Administrator is directed to forth- <br />with advise the Applicant that this resolution <br />has been adopted and to obtain a statement in <br />writing from the Applicant to the effect that its <br />representative ahs received a copy of this reso- <br />lution; and <br /> <br />d) That there be a marketable title for the property <br /> known as West Oaks P.U.D. <br /> <br />The motion for the adoption of the foregoing resolution was duly <br />seconded by Councilmember and upon vote being taken <br />thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br /> Resolution ~85- <br /> <br />-2- <br /> <br /> <br />
