CITY OF RAMSEY <br /> <br />UNIT DEVELOPMENT <br /> <br /> Development Agreement by and between the City of Ramsey, <br />Minnesota (City), and North Fork, Inc., a corporation organized <br />under the laws of the State of Minnesota (Developer). <br /> <br /> WHEREAS, Developer is the owner of certain real property <br />situated in Anoka County, Minnesota, located in the City of <br />Ramsey, the legal description of which real property is attached <br />hereto as Exhibit "A"; and <br /> <br /> WHEREAS, the name of the proposed Planned Unit Development <br />is West Oaks, hereinafter referred to as "P.U.D."; and <br /> <br /> WHEREAS, Developer desires to effect the recording of the <br />P.U.D. with the Anoka County Recorder, upon the execution and <br />approval thereof by the City Council of the City of Ramsey, <br /> <br /> NCW ~]~EREFORE, in oonsideration of the mutual covenants and <br />promises oontainedherein, it is agreed as follows: <br /> <br /> 1. ~ The parties acknowledge that the P.U.D. <br />is sutmitted pursuant to the City (]ode of the City of Ramsey, and <br />specifically submitted pursuant to the planned unit development <br />section of said Code, and is the subject of a previous written <br />planned unit development plan on file and of record with the City <br />of Ramsey, for which concept approval has been previously given <br />by the City Gouncil of the City of Ramsey. The parties further <br />acknowledge that said planned unit development incorporates <br />single family residential usage, open space recreational usages, <br />and four (4) Outlots, which Outlots shall not be developed and/or <br />improved without compliance with the Minnesota Environmental <br />Quality Board (EQB). <br /> <br /> 2. Improvements Public improvements to be incorporated <br />and constructed in conjunction with the project include streets <br />to be known as White Tail Trail, White Tail Court, White Tail <br />Circle, WhiteTail Way andWhiteTail Lane, as shown on the plat, <br />hereto attached as Exhibit 'B", and drainage easements to be as <br />recommended by the City Engineer. The Developer shall be <br />responsible for the expenseassociatedwiththisconstruction. <br /> <br /> <br />
