I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />i <br />I <br />I <br /> <br />DECLARATION OF COVENANTS, CONDITIONS <br />AND RESTRICTIONS FOR <br /> NORTHFORK <br /> <br /> THIS DECLARATION (hereinafter referred to as the <br />"Declaration"), Is made this day of , 1985 by <br />Northfork, Inc., a Minnesota corporation (hereinafter referred <br />to as ;'Declarant"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS: Declarant is the owner of certain real property <br />located in Anoka County, Minnesota, designated as "NorthFork", <br />and legally described in Section l.l hereof (hereinafter called <br />the "Property"), and desires to create thereon a resiOential <br />community with open spaces and common area facilities for the <br />health, safety, recreation and general benefit of said <br />community; and <br /> <br /> WHEREAS, Declarant desires to provide for the preservation <br />of the values, aesthetic character and amenities in said <br />community and for the maintenance of open spaces and other <br />common facilities and to this end desires to subject the <br />Property, together with such additions as may thereafter be made <br />hereto, to the covenants, restrictions, easements, charges and <br />liens (hereinafter sometimes called the "Covenants and <br />Restrictions") hereinafter set Forth, ali of which are For the <br />benefit of said Property and each Owner and Occupant, and <br /> <br /> WHEREAS, Declarant has incorporated, under the laws of the <br />State of Minnesota, Northfork Homeowners Association, Inc., a <br />nonprofit corporation, which has been delegated and assigned the <br />power and duty to maintain and administer Common Property, to <br />administer and enforce the Covenants, Conditions and <br />Restrictions and to collect and disburse the assessments and <br />charges provided for herein. <br /> <br /> NOW THEREFORE, the Declarant declares that the Property, <br />and such additions thereto as may hereinafter be made, is and <br />shall be held, transferred, sold, conveyed, used and occupied <br />subject to the covenants, conditions, restrfetions, easements, <br />charges and liens hereinafter set forth. <br /> <br />ARTICLE I <br /> <br />DEFINITIONS <br /> <br /> Section 1.1 The Following words, when used in this <br />Declaration (unless the context shall prohibit), shall have the <br />Fo)lowing meanings: <br /> <br />a.
