In regards to the issue I find the following: <br /> 1) A copy of the proposed finding and order regarding <br /> Partial Abandonment of County DitCh No. 43. No signed <br /> copy was located in our offices. Proposed Findings were <br /> dated January 13, 1981. <br /> 2) A copy of Resolution #80-119 adopted by the City of Ramsey <br /> on the 23rd day of September, 1980. Copy attached. <br /> 3) A plan showing planned construction of an outlet of the <br /> ponds located North and East of Flintwood Hi].ls Addition. <br /> Presumbly the plan referred to in Items "2, 3, and 4" on <br /> the enclosed Resolution #80-119 of the City of Ramsey. <br /> <br />From my review of this information, it appears that in submitting <br />the Petition for Abandonment of a part of County Ditch No. 43 <br />that both the City and Developer made commitments to the County <br />to "maintain the continuity of Ditch #43" (as stated in Item <br />Number "4") on the enclosed Resolution. <br /> <br />It appears that the County, in granting the Petition to Abandon a <br />part of County Ditch No. 43, had great cause to believe that the <br />City intended to and in fact was committed to replace the then <br />existing tile with a new Storm Sewer System at its expense or at <br />the expense of the Developer of Flintwood Hills Second Addition. <br /> <br />Affirmative Action / Equal Opportunity Employer <br /> <br /> <br />
