Councilman Sorteberg introduced the following resolution and moved for its <br />adoption: <br /> <br /> RESOLUTION ~80-119 <br /> <br /> WHEREAS~ County Ditch #43 traverses through the City of Ramsey <br />on property which is where the proposed plat of Flintwood Hills Second <br />Addition is to be located, and <br /> <br /> ~+LEREAS, said County Ditch ~43 is in a current state of dis- <br />repair and apparent2y not functioning, and <br /> <br /> WHEREAS, even though said ditch is not functioning the City <br />finds it is in the best interests of the community to continue the original <br />function of County Ditch #43, and <br /> <br /> WHEREAS,-the developer of Flintwood Hills Second Addition has <br />requested that the City of Ram~ey agree with said developers petition for <br /> abandonment of Ditch #43 and out certain <br />partial <br /> County <br /> setting <br /> properties <br />from said drainage system, which petition will be presented to the Anoka <br />County Board of Commissioners. <br /> <br />NOW ~ORE, TEE RA~&SEY CITY COUNCIL HEREBY RESOLVES, as follows: <br /> <br /> 1) To approve the partial abandonment of. the present alignment <br />of Ditch $43 as proposed by the developers petition and to so advise the <br />Anoka County Board of Commissioners of this action. - o <br /> <br /> 2)· To approve' the relbcation of Ditch #43 as proposed by the <br /> developers in its petition. <br /> <br /> 3) To enter into an agreement with the developer for installation <br /> of the relocated ditch in areas of the proposed plat not served by the storm <br />water system in order to maintain the continuity of Ditch #43. · ' <br /> <br /> 4) That.in order to maintain the continuity of Ditch #43, require <br /> a storm water system including piping large enough to serve this specific plat <br /> as required by existing City <br /> the <br /> Code. <br /> <br /> The-motion for the adoption of the foregoing resolution was duly seconded <br /> by Councilman Mickelson and upon vote being taken thereon, the following <br /> voted in favor thereof: <br /> <br /> Mayor 6amec, Councilmen Sorteberg, l;dckelson, Rei~un and Cox <br /> <br /> and the following voted against the same: <br /> <br /> None <br /> whereuoon'said resolution was declared duly passed and adopted by the Rmmsey <br /> City C~uncil this the 23rd day of September, 1980. <br /> <br /> <br />
