I Subsection ~.6. ~nvlronmental Control ?he proposed <br /> development act/v~tie~ in the Development S~lstrlct~ do not <br /> present significant environmental concerns. All <br /> I actions, public improvements and private development shall <br /> be carried out in a manner consistent with existing environ- <br /> mental standards. <br /> I Subsection 1.?. Pro sad Reuse of Pro rt . ?he public <br /> improvements needed to bring about the new development in- <br /> clude acquisition of land, site improve=eats, and general <br />I improvements. The estimated public improvement costs are <br /> referenced in each of the tax increment financing plans and <br /> i are collectively described in Subsection <br /> The Development. Program does not contemplate the acqui- <br /> sition of private property until such time as a private <br />I developer presents an economically program £or the <br /> feasible <br /> reuse of that property. Proposals, in order to be consid- <br /> ered, rust be within the framework of the above cited goals <br />I and objectives, and must clearly feasibility <br /> demonstrate <br /> as <br /> a public progrmn. Prior to formal consxderation of the <br /> acquisition of any property, the City Council will require a <br />I binding contract, performance bond and/or other evidence or <br /> guarantees that a supporting tax increment or other funds <br /> will be available to repay the public cost associated with <br />I the proposed acquisition. It shall be the intent of the <br /> City to negotiate the acquisition of property whenever nec- <br /> essary. Appropriate restrictions regarding the reuse and <br />I redevelopment of property shall be incorporated into any <br /> land sale contract to which the City is a part. . <br /> <br />I Subsection 1.8. Administration and Kaintenance of De- <br /> velopment District. Ita~ntenance a~d operation o~ the publ£~ <br /> improvements will be the responsibzlity of the Administrator <br /> <br /> of the City who shall serve a~'A.dm£nist~ator of the Develop- <br />I ment District. The powers, duties and responsibilities of <br /> the Ad=inistrator are spelled out in the Admin~strative <br /> <br /> Guide for the. Administration of the Development Progr.a~. for <br />I Develolxnent Dzstr£ct No. 1, attached hereto as &ppendzx A. <br /> Each year the l~lministrator will submit to the-Council the <br /> <br /> maintenance and operation budget for the following year <br />I The Administrator will administer the Development *Dis- <br /> trict pursuant to the provisions of Section 472A.10 o~ the <br />I Development District Act; provided, however, that such <br /> ers sm~ only be exercised at the direction of the Counc-il. <br /> Ho action taken by the A~ministrator pursuant to the above- <br />I mentioned povers shall be effective without authorization by <br /> the Council. <br /> <br /> Subsection 1.9.
