I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />i <br />I <br />I <br />I <br />I <br />I <br /> <br />PRO~OS~ D~V~.OPMENT ;~~T <br /> <br /> RE CITY OF RAMSEY <br /> AND <br /> M & S D~V~LOPMENT <br /> <br />This agreement entered into this day of , <br />1985, between the City of Ramsey, hereinafter referred to as <br />"City," and M & S Development, hereinafter £eferred to as <br />"Applicant," in oonjunction with the issuance to the Applicant of <br />a variance to encroach on the required side yard. <br /> <br />The variance is hereby granted contingent upon the Applicant <br />agreeing to and o0~plying with the foll~ing oondit/ons: <br /> <br />~hat the Applicant shall suh~it a landscaping plan <br />for the remaining side yard to City staff for re~iew <br /> <br />~at the Applicant shall file with the City a deposit <br />sufficient to cover the above landscaping, including <br />all materials and labor, as determined by the City <br />~gtmeer. ~his deposit shall be in the smount of <br />$ · <br /> <br />3. ~hat the Applicant shall properly maintain the <br /> landscaped side yard. <br /> <br />4. ~at this varianoe shall ap~ly to that property legally <br /> described as Lot 2, Block 1 Oxbow <br /> <br />5. ~at this develop~t agreement shall he recorded as a <br /> part of the Applicant's Deed. <br /> <br />~he Applicant understands and agrees that the variance granted <br />herein in subject to review at any time. <br /> <br />Any violations of the conditions described herein or any <br />violation of any other City ordinances may be cause for immediate <br />revocation of this variance. <br /> <br /> <br />
