Councilmember <br />findings of fact: <br /> <br />moved the adoption of the following <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />1. That the Applicant has properly applied for a Board of <br />Adjustment variance to construct an accessory structure before <br />oonstructing the p~incipal building on the site. <br /> <br />2. That the Applicant appeared before the Board of Adjustment <br />for a public hearing on July 23, 1985, and that said public <br />hearing was properly advertised and that the minutes of said <br />public hearing are hereby incorporated as a part of these <br />findings by reference. <br /> <br />3. That the Applicant's property is Lot 2, Block 1 High Point <br />Second Addition and is located in the R-1 Residential District. <br /> <br />4. That the subject property is approximately nine acres in <br />size. <br /> <br />5. That the Applicant's request is to construct a 30' x:~§~4.' <br />accessory structure before the principal structure is <br />constructed. <br /> <br />6. ~hat the City O0de states that no accessory structures may be <br />constructed on a site until the principal structure has been <br />constructed on the site. <br /> <br /> 7. That there may be exceptional, unique or extraordinary <br />I circ~nstances or conditions applying to the property in question <br /> as to the intended use of the property that do not apply <br /> generally to other ~xoperties in the _~me zoning district. <br />I 8. ~hat such variance may be necessary for the preservation and <br /> <br />enjoyment of a substantial property right similar to that <br /> <br /> possessed by other properties in the same district and in the <br />I same vicinity. The possibility of increased financial return <br /> shall ~ot in itself be ~ed sufficient to warrant a variance. <br /> <br />I <br /> <br />! <br />I <br /> <br />9. That the authorization of such variance will not be of <br />substantial detriment to adjacent property and will not <br />materially h~r the intent or purpose of this ordinance or the <br />public interest. <br /> <br />10. Gat the condition or situation of the subject .property, or <br />the intended use of the property for which the variance is <br />sought, is not of so general or recurrent a nature as to make <br />reasonably practicable the formulation of a general regulation <br />for such oor~litions or sit~ation. <br /> <br />'1 <br /> <br /> <br />
