1937553 <br /> <br />Councilmember Cook introduced the following resolution and moved for its adoption: <br /> RESOLUTION #03-05-110 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO EXCEED THE ACCESSORY BUILDING SIZE RESTRICTION BASED ON <br />FINDINGS OF FACT #0647 AND DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, Daryl & Carol Richmond (Permittee) have properly applied for a <br />conditional use permit to exceed the accessory building size restriction for properties located <br />outside the Metropolitan Urban Service Area (MUSA) established in section 9.11.02 "Accessory <br />Uses" of City Code on the property generally known as 17623 Marmoset St NW and legally <br />described as follows: <br /> <br />Lot 3, Block 4, Countryside Estates, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on May 1, 2003, conducted the <br />public hearling and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0647, a conditional use permit (Permit) to exceed the accessory <br />building size restriction for properties located outside the MUSA as established in City Code, <br />is hereby granted to Daryl & Carol Richmond, hereinafter referred to as the "Peixnittee". <br /> <br />That the detached accessory building may exceed the 1,664 square foot accessory building <br />size restriction for properties located outside the Metropolitan Urban Service Area by a total <br />of 400 feet in order to accommodate the inside storage of vehicles, a boat, and other personal- <br />use equipment. <br /> <br />3. That the construction of the detached accessory building on the Subject Property shall require <br /> issuance of a building permit from the City of Ramsey. <br /> <br />4. That the accessory building shall be properly constructed and maintained in accordance with <br /> all applicable Building Codes. <br /> <br />5. The Permittee herein agrees that no business use will be operated in the detached accessory <br /> building unless such use is permitted in accordance with the City Code. <br /> <br /> <br />
