That the Applicant has applied for a Board of Adjustment <br /> variance to o0nstruct an aocessory structure in his front yard. <br />I 2. That the Applicant appeared before the Board of Adjustment <br /> for a public hearing on September 24, 1985, and that said public <br /> hearing was properly advertised and that the minutes of said <br />I public hearing are hereby incorporated as a part of these <br /> findings by referenoe. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />3. That the Applicant's property is genera/ly known as 17211 <br />Germani~ Street N.W. and is located in the R-1 Residential <br />District. <br /> <br />4. That the subject lxoperty is approximately 2.6 acres in size. <br /> <br />5. That the Applicant's request is to construct an accessory <br />structure in the front yard. <br /> <br />6. ~hat the City Code allows for the construction of accessory <br />structures only in the side or rear yards. <br /> <br />7. That the Applicant has stated that due to the gemetrical <br />shape of the lot and the location of the principal structure on <br />the lot, there are exceptional, unique or extraordinary <br />circumstances or conditions applying to the property in question <br />as to the intended use of the property that do not apply <br />generally to other p~operties in the same zoning district. <br /> <br />8. ~hat the Applicant has stated that the variance is necessary <br />for the preservation and enjoyment of a substantial property <br />right similar to that possessed by other properties in the same <br />district ar~ in the same vicinity. The possibility of increased <br />financial return shall not in itself be deemed sufficient to <br />warrant a variance. <br /> <br /> 9. That the authorization of such variance will not be of <br /> substantial detriment to adjacent property and will not <br /> materially impair the intent or purpose of this ordinance or the <br /> public interest. <br />I 10. ~hat the cor~lition or situation of the subject property, or <br /> the intended use of the property for which the variance is <br /> <br />sought, is not of so general or recurrent a nature as to make <br />reasonably practicable the formulation of a general regulation <br /> <br />for such cor~litions or situation. <br /> <br /> <br />
