BERNARD D, $ITZ, <br />7210 - 149'/~ LANE N~ <br /> <br /> WREREAS, Mr. Bernard Sitz requested by letter dated September 13, <br />1985 that his street improv~rent special assessment for sealcoating in the <br />a~omt of $236.75 be deferred as provided by City Code Chapter 210.012H which <br />was introduced into the Gouncil minutes at the public hearing held on September <br />17, 1985; and <br /> <br /> WBERFAS, City Rode Chapter 210.012H provides for the deferrment of <br />paying special assessments when the property owner makes written application <br />and falls within the purview of this City fbde; and <br /> <br /> W~EREAS, the Rawsey City Council is aware that City Code Chapter <br />210.012H, Subparagraph 5A(b) requires that the special assessment to be <br />deferred must exceed $300. Bowever, the Code further states that the Council <br />may consider exceptional and unusual circumstances when applying the Code <br />requir~rents. <br /> <br />NUN ~~kRE, BE IT RES(~V~D BY ~E CI~ (~NCIL ~F ~E CITY OF RAMSEY, ANOKA <br />(IX]WI~, S~%TE OF ~ as follows: <br /> <br /> 1) The City Council hereby grants Mr. Bernard Sits, 7210 - 149th <br />Lane ~, deferral of his special asses~ent for public impro¥~ents as stated <br />above in the ~rount of $236.75. <br /> <br /> 2) Interest on deferred assessment shall be accrued at the sa~e rate <br />as on non-deferred asses~rent. ~e maxiwur ~rount due on the assessment will <br />be the original asses~rent plus interest accrued during the original assessment <br />ter~. <br /> <br /> 3) Termination of right to deferred payment - The option to defer <br />the l~y~ent of special asses~rents shall tenrinate and all a~ounts accumulated <br />plus applicable interest shall become due upon the occurrence of any of the <br />following events: (a) the death of the owner, provided that the spouse is <br />otherwise not eligible for the bermfits of this section; (b) the sale, transfer <br />or subdivision of the p~operty or any pert thereof; (c) if the property should <br />for any reason lose its homestead status; or (d) if for any reason the City <br />Council shall determine that there would be no hardship to require immediate or <br />partial payment. <br /> <br /> 4) It is hereby directed that the City Finance Officer establish a <br />deferred assessment roll in the City for the Pineview Estates Public <br />Iwprove~ent Sealcoating Project #85-11 regarding Bernard Sitz, 7210 - 149th <br />Lane N~ in the a~ount of $236.75 plus interest at an annual rate of 8.65%. <br />This shall be monitored by the Finanoe Officer. <br /> <br /> 5) It is durected that a oopy of this resolution be filed with the <br />recorder of deeds of Anoka County. <br /> <br /> <br />
