ANDERSON REZONING REQUEST <br /> <br />Motion by Councilman Reimann and seconded by-Councilman Gamec to adopt the <br />following finding of facts-and based-on.said-finding:to:deny~:-the, rezoning <br />request of Dr. T. W. Anderson. <br /> <br />1) That applicant applied to the,City to-rezone:a five.acre tract of <br />land on the NE comer of 167th Avenue from Residential (R-l) to Business <br />(B-l). <br /> <br />2) That the subject property is located in the Transitional Area of the <br />City. <br /> <br />3) That the City Council held a duly advertised and noted public hearing <br />on the applicationonAugust~2I, 1978, which:publichearingminutes arein .... <br />corporated herein by-referencer- <br /> <br />4) That the Planning Commission reviewed the. application and made recommend- <br />ations to the City Council in its minutes of August 21, 1978 and October 10, <br />1978, which recommendations the City C~uncil has reviewed. <br /> <br />5) That the applicant requested that the matter not be placed on the City <br />Council's agenda of August 28, 1978. <br /> <br />6) That the City, after numerous public hearings, meetings and study <br />adopted an amendment to its Comprehensive Plan, said amendment being <br />dated March 15, 1976 and revised March, 1978. <br /> <br />7) That the goals, policys and objectives of said amended Comprehensive <br />Plan are adopted hereinby reference. That specifically the amended <br />Comprehensive Plan provides that the urban area of the City shall be <br />south of 155rd Avenue for the reasons as set forth in the Comprehensive. <br />Plan amendment. <br /> <br />8) That land is available for a use as proposed by the applicant in area <br />below 153rd in the Urban Area. <br /> <br /> <br />
