CASE 2' <br /> <br />CASE 3: <br /> <br />CASE 4: <br /> <br />CASE 5: <br /> <br />OFF- SALE LIQUOR APPLI CATIONS <br /> <br />Background; Council reviewed all the applicants at a special <br />meeting on November 2~ 1978._ Council also informed the appli- <br />cants they would make their decision on their findings at <br />this meeting. <br /> <br />METES AND BOUNDS PLAT REGARDING TOM HOLKER <br /> <br />Background: Mr. Holker ts attorney presented Council with the <br />fOllOwihg two requests; <br /> <br />a) Request for a metes and bounds plat (please refer to <br />Exhibit #1 on the left side of the agenda) Council reviewed <br />this plat on November 2, 1978 and referred it to the Planning <br />and Zoning Commission for their review and for their comments. <br />(Please refer to enclosure (B-l), They approved the plat as it <br />conforms to State Laws and our Subdivision Code. <br /> <br />b) IIolker's other request is to get Council approval on the <br />moved in shell house that is currently located on Parcel B <br />of this metes and bounds plat. <br /> <br />Comments: In reviewing our ordinance in regards to metes and <br />bounds platting where it involves 5 acre parcel or move, such <br />as we have in this case, we are pretty much governed by State <br />Laws and I don't believe he has to have Council approval on <br />this plat. I want to review this more with the City Attorney <br />to get his thoughts. If the above is the case, we should <br />probably get direction from Council if they want to try and <br />tighten up the ordinance in this area. I guess the legislators <br />in their wisdom wanted to give the landowner some freedom in <br />the development of this land, <br /> <br />Council action: Will be twofold l) approve the metes and <br />bounds plat and 2) to act on the shell house presently <br />located on parcel B of the above plat, <br /> <br />REZONING FRED ARMSTRONG PROPERTY FR~M RURAL SERVICE TO TRANSI- <br /> <br />TIONAL <br /> <br />Background: In accordance with Council instructions (Enclosure <br />A-l) your minutes dated October 23, 1978 this agenda) this was <br />taken to the Planning Commission on November 6, 1978. Please <br />refer to enclosure (B-i) this agenda.' I am also enclosing as <br />enclosure (Dl-f) their previous recommendation which was amended <br />at their meeting of November 6, 1978, <br /> <br />Comments: I think.their finding of fact as recommended now meets <br />the total requirements for this rezoning request <br /> <br />AMEND SECTION 170.019 OF ZONING ORDINANCE REGARDING PUBLIC HEARING <br /> <br />Please refer to enclosure (B-i) Planning Commission minutes dated <br />November 6, 1978, this agenda, I will try and have prepared a <br />recommended change for your review and discussion. <br /> <br /> <br />
