That the City Cotmcil held a duly advertised and noted public hearing <br />on the application on August 21, 1978, M:ich public hearing minutes are in-. <br />co'rpor~ted herein by reference. <br /> <br />4. That the Planning Commission reviewed the application and made recommend~ <br />at.ions to the City Council in its minutes of August 21, 1978 and October 10~ <br />]978, wh:ich reco,~nendations the City Com~cil has reviewed. <br /> <br />5. 'II,at the applicant requested that the matter not be placed on the City <br />Conncil's agenda of August 28, 1978. <br /> <br />6. 'lZat the City, after m~nerous public hearings, meetings and study <br />adopted an amendment to its Comprehensive Plan, said amen&nent being <br />da~ed March ]5, 1976 and revised March, 1978. <br /> <br />7. 'fl~at the goals, policys and objectives of said amended Comprehensive <br />Plan are adopted herein by reference~ That specifically the amended <br />Comprehensive Plan provides that the urban area of the City shall be <br />south of 153rd Avenue for the reasons as set forth in the Comprehensive <br />P] ~n amendment. <br /> <br />8. That land is avai]able for a use as proposed by the applicant in area <br />below i53rd in the Urban Area. <br /> <br />9. That the only co~nercial business's operating in the general area <br />of that proposed by the applicant to be rezoned are those business's which <br />are located in building's existing prior to the Comprehensive Plan amendment. <br /> <br />10. That to permit the proposed use and rezoning request would act as a <br />precedent to other similar commercial uses and rezoning requests and this <br />would not be in conformance with the City's planning objective, and re- <br />quirements as prescribed in the Comprehensive Plan and its amendments~ <br /> <br />11. That the area proposed for rezoning is not served by any municipal <br />utilities. <br /> <br />12. That the City Council recently denied a similar business rezoning re~ <br />quest for the property South of 167th and West of Highway 47~ <br /> <br />13. That the City Council received and reviewed a written petition <br />signed by some 400 individuals who indicated they were in favor of the <br />applicants Janprovement. <br /> <br /> <br />
