civil <br />municipal <br />planning <br />environmental <br />land surveying <br />geotechnics <br /> <br />consulting en© neer$ dlvers f ed nc, <br /> p.o. box j. osseo, minnesota 55369 '.:~ ((~12) 425o218~i <br /> <br />November 22, 1978 <br /> <br />Honorable Mayor and City Council <br />City of Ramsey <br />15153 Nowthen Boulevard N.W. <br />Anoka, Minnesota 55303 <br /> <br />Re: Holker's Realty <br /> Metes & Bounds Subdivision <br /> <br />Dear Council Members: <br /> <br />As requested at your last council meetin§, we have reviewed the access problem <br />in regard to the above referenced subdivision. <br /> <br />In discussing the above matter with the developer's surveyor, we agreed that the <br />bes't solution to the problem from a planning standpoint is to construct a street <br />and subdivide the property as shown on the preliminary plat of High Point~ However, <br />the developer feels it is more economical to proceed with the subdivision of the <br />property into three large tracts with no street construction. <br /> <br />If it is the opinion of the city attorney that this subdivision falls under the <br />jurisdiction of the City's Subdivision Ordinance, t. he city may restrict access to <br />the parcels under Article 170.038E of that ordinance. However, if the Minnesota <br />State Statutes governing mates and bounds subdivision take precedence the city may <br />not have the authority to restrict access totally. <br /> <br />If the city is forced into accepting the metes and bounds subdivision, we would <br />agree with the recommendation made by Paul Ruud concerning the accesses. However, <br />we would recommend that the city require the developer deed access to the city <br />along both C.S.A.H. No. 5 and Co. Rd. 57 with the exceptions of the north 30 feet <br />on Parcel C, the south 30 feet on Parcel B and the existing access to Parcel A. <br />We Would also recommend that the city require the developer to state on the deeds <br />to each parcel that access to the parcels may be restricted to right turn ingress <br /> <br />- Continued <br /> <br />keith caswell jr. =i darrell schneider ,~ richard sha <br /> <br /> <br />
