~ECT <br /> <br /> The 208 Areawide Plan'For Water Quality Management was prepared pursuant to <br />Section 208 of the Federal ~lean Waters Act. When adopted, it will supersede the~ <br />current Development Guide/PoliCy Plan On Waste Water Management. This document <br />will be used by the Council in processing referral~ such as for State and Federal <br />financial assistance for local units of government; in making decisions about Council <br />programs and activities; in reviewing Metropolitan Waste Control Commission (MWCC) <br />development program and capital budget; and in reviewing matters of metropolitan <br />significance. · -. <br /> <br /> The plan'addresses the metropolitan system, municip~l systems, private systems, <br />and individual on-site systems as they relate to water quality. The plan sets forth <br />policies and standards for managing and regulating water quality-related facilities, <br />including the sewer portion of the local comprehensive plans required by the <br />Metropolitan Land Planning Act. <br /> <br />~CT ON LOCAL UNITS OF GOVERNMENT <br /> <br /> The plan, as it relates to on-site systems, sets minimum standards for design, <br />location, construction and maintenan6e. The plan sets minimum program requirements <br />for local'units of government for.regulating on-site systems, permit application and <br />review, record keeping and reporting, and operational surveillance and monitoring. <br />Specific portions of the policies and/or standards which may be of concern to local <br />units of 9overnment are as follows: : <br /> <br />1. Local unit of government regulatory program to prevent economic harm (Pol. 39). <br /> <br />Local unit of government to conduct operati6nal monitoring maintenance program. <br />Mandatgry maintenance in areas of high .on-site s~stem incidence. Ail <br />systems to be inspected biennually and reports retained-by--the local unit <br />of government (Pol. 44 & 47) (Std. 3). <br /> <br />3. Local unit of.government to advise potential on-site system users of soil <br /> suitability and limitations for on-site systems.in-advance.of land purchase <br /> (Pol. 36). <br /> <br />4. Duplication of activities by. the MWCC in providing assistance to local units <br /> of government and undertaking so~l suitability studies (Pol. 51 a & f) and <br /> by the Metropolitan Council in setting standards for grant reviews (Pol. 51 h). <br /> <br />5. MWCC to provide non-sewer septage disposal facilities (Pol. 51 b). <br /> <br />6. Counties to l~cense and regulate activities of pumpers and haulers (Pol. 51 c). <br /> <br />7. Counties to provide technical assistance and to review permits when requested <br /> by local units of government (Pol. 51 f). <br /> <br />Metropolitan Council to propose legislation to prohibit plat filing until <br />certification has been issued by a local'unit of government for a proposed <br />on-site system (Pol. 52 b) and to require certification of on-site system <br />by local unit of government at the time of sale of the prOPerty (Pol. 52 c). <br /> <br />9. Adequacy of local on-site system management control program to affect local <br /> unit of government's application for other monies (Pol. 52 <br /> <br />10. Local unit of government to maintain records on each on-site system on the <br /> design, location, soil, environmental analysis, and maintenance activities <br /> <br /> <br />
