not be development for a certain period of time, and the easemem would just be used for a
driveway for the time being.

Councilmember Cook stated he would like to see the Council go ahead with his motion, and
agreements relating to the easement would have to be worked out with the property owners. Mr.
Bauer would have to develop his property for the City to want to put a road tl~n'ough there.

Mr. Bauer replied that is possible, and people do not need to third_lc that as soon as this were to
happen there would be an expectation of a road tutoring through there.

Councilmember Cook indicated if the City went tl:u'ough with this action they could negotiate
something w/th Mr. Batter finar~cially for having the driveway there, but that would be separate
from this.

Councih'nember Pearson asked how large Mr. Bauer's parcel is, and how much is buildable.
Mr. Bauer replied the entire subdivision is just over 13 acres. There is wetland on the property
and there was delineation done. There would be about seven buildable acres at the most. The
ghost plot is accurate as to what lots there could be, but it is not accurate as to what is the
buildable property. He noted to develop the propetV; City sewer and water would be needed.

Ms. Kaas questioned when Mr. Bauer might develop the property.

Mr. Batter replied at this time, as far as he k3~ows there is no expectation for City sewer and
water. At this time he does not plan on developing it at all.

Mr. Dusbabek stated his position would be if the City looks at purchasing the easement it sounds
like they can put conditions in there about future development. The easement would not be
utilized until there was a need for it, other than possibly cursory ~ading for the driveway
purpose. Once there is City sewer and water available the easement would be opened up if the
land is developed further. His position is that if that were to take place the developer would bear
the costs of putting those assessments in.

Mayor Gamec commented the driveway would remain as a ~avel road until there was to be any
further development that would take place.

Councilmember Zimmem~an stated Mr. Dusbabek is willing to sell an easement to Mr. Bauer,
but the Kaas party is not. He does not thi~c he would be in favor of condemning one person's
land for the sake of someone else.

Mr. Dusbabek stated he does not want more trees comi~g down. He would be willing to sell to
the City, but not a private patty; that is the only way to do this in a timely time frame to keep the
road fi'om coming in behind him and hnpacting him further. If Mr. Bauer is forced to put the
road in through the north, he would not have an interest i~ selling that easement.

-126-

City Council/July 27, 2004
