Nuisances Affecting Public Peace <br /> by Chief Jim Way <br /> <br />Background: <br /> <br />The Chief of Police and City Attorney reviewed Ramsey City Code Chapter 5.08, Public <br />Nuisance. They discussed their recommendations to amend the code as it affects public <br />peace, with the Ramsey City Council, at a Work Session held on July 13, 2004J The <br />pm-pose of the Public Nuisance Section is to take all reasonable measures within the <br />City's jurisdiction to prevent the establisbr~ent of activities that maintain or permit a <br />condition which um'easonably annoys, injures or endangers the health, morals, decency, <br />safety, or public peace so that such activities do not affect the comfortable enjoyment of <br />life or property. Nuisances affecting public peace include ,the use sound devices at a <br />volume in excess of that reasonably necessary for convenient hearing or that are likety to <br />cause injury to the person or property of anyone and to interfere with the comfortable <br />enjoyment of life or property. Reasonable sound levels have been established and a <br />measurement procedure is available to obtain measurements, using a sound measuring <br />device (decibel meter). <br /> <br />Recommendation: <br /> <br />Staff recommends amending Section 5.08 "Public Nuisance" by repealing the existing <br />section and replacing it with the new Section 5.08, to expand the as it relates to public <br />peace. <br /> <br />Council Action: <br /> <br />Motion by City Conncil to repeal City Code, Section 5.08 "Public Nuisance". <br /> <br />Motion by City Council to introduce the ordinance adding the new Section, 5.08, which <br />will continue to be called "Public Nuisance". <br /> <br />Reviewed by: <br /> <br />Police Chief Jim Way <br />City Attorney Bill Goodrich <br />City Administrator Jim Norman <br /> <br />-275- <br /> <br /> <br />
