CASE #: q <br /> <br />REQUEST FOR FINAL PLAT REVIEW OF ALPINE ACRES 4th ADDITION <br /> CASE OF OAK CREEK BUILDERS <br /> By: Megan Wald, Associate Planner <br /> <br />Background: " <br /> <br />Oak Creek Builders has applied for final plat approval of Alpine Acres 4th Addition consisting of <br />42 townhome units. The property, is generally located in the triangular area formed'by Nowthen <br />Blvd., Sunfish Lake Blvd., and Alpine Drive. <br /> <br />The following items are enclosed for your review: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Final Plat <br />City Staff Review Letter dated' July 23, 2004 <br />Resolution approving the final plat <br />Proposed Development A~eement <br /> <br />Notification: <br />State statute does not require notification of applications for final plat approval. <br /> <br />Observations: <br /> <br />The preliminary plat approved by the City Council on June 24, 2003 consists of 200 townhouse <br />units and two existing single-family home. The fourth phase of Alpine Acres conforms to the <br />approved preliminary, plat. The Final Grading Plans, Construction Plans and Specifications have <br />been reviewed by the City Engineer and are acceptable. <br /> <br />Park dedication, trail fees, and storm water management fees for the third phase will consist'of a <br />cash payment. <br /> <br />The City recently established an ordinance adopting MN State Building Code Amendment 1306. <br />A portion of the amendment requires residential dwelling structures over 8,500 square feet in <br />size to install a fire sprinkler suppression system. The ordinance became effective on July 23, <br />2004. The effective date established in the ordinance relates to receipt of building pennis and <br />does not address situations where subdivisions contain established streets and infrastructure and <br />building permits have not been received. This is the case for Alpine Acres 4th Addition, a <br />signilScant portion of tlxe streets and infrastructure is already constructed within the fourth <br />addition. In order for Alpine 4th Addition to comply with 1306, the existing streets will have to <br />be removed, infrastructure resized, and streets reconstructed. Staff does not see the advantage of <br />disturbing existing streets and infrastructure; therefore in situations where a residential structure <br />is located adjacent to existing streets and infrastructure that was 'installed prior July 23, 2004, <br />staff suggests that the City waive the amended 1306 compliance requirement. It should be noted <br />that Alpine Acres 4th Addition contains 16 units where streets and infrastructure has not been <br />installed [o date. Compliance with amendment 1306 is in a transitional period, best efforts should be <br />made to comply with the fire sprinkler suppression requirement, however due to the fact that only 8 <br />percent of the development has the potential to be serviced by fire sprinkler suppression, staff is <br />recommending that the City waive the fire suppression requirement in this case. <br /> <br />-325- <br /> <br /> <br />
