g) <br /> <br />minimize impact on trees to be protected within or outside of the Plat. Wood waste <br />disposal by fire must also manage air quality impact and smoke nuisance to adjoining <br />property owners as well as fire safety concerns. <br /> <br />Whole trees may not be disposed of by bun-ting. Trunks and limbs larger than six (6) <br />inches in diameter must be salvaged for lumber, firewood, chipped or hauled to a <br />licensed wood disposal site. Application may be made for an open burning permit to <br />dispose of brush less than six (6) inches in diameter and stumps with less than four <br />feet of main trunks attached. The location of the proposed open burn site will 'be <br />specified by the CITY. Wood disposal by burning requires whole tree volume <br />reduction, proposed site inspection prior to clearing and an open burning permit. <br />Residual ash and unburned smmpage may be buried on the site at the approval of the <br />CITY. Chipped material may be applied and utilized on site to mitigate root damage <br />from grade changes or used in the right-of-way for erosion control and top soil <br />restoration. <br /> <br />SECTION VI <br />GENERAL <br /> <br />23. Amendment to MN State Building Code 1306 requirement. The City recently adopted <br /> MN State Building Code Amendment 1306. A portion of the amendment requires residential <br /> dweliing structures over 8,500 square feet in Size to install a fire sprinkler suppression <br /> system. The ordinance became effective on July 23, 2004 and states that any building permits <br /> received by the City subsequent to July 23, 2004 will be required to comply with the 1306 <br /> amendment. A significant portion of the overall infrastructure within Alpine Acres <br /> subdivision was installed prior to the July 23rd effective date. It is the CITY'S position that <br /> residential dwelling structures will not be subject to compliance with amendment 1306 in <br /> situations where streets and infrastructure was installed prior to the effective date of said <br /> ordinance. Since a portion of the existing streets and infrastructure is located within Alpine <br /> Acres 4m' Addition, the Plat wilt not be subject to compliance with the 1306 amendment. <br /> Alpine Acres 4th Addition contain2 16 units where streets and infrastructure has not been <br /> installed to date. Compliance with amendment 1306 is in a transitional period, best efforts <br /> should be made to comply with the fire sprinkler suppression requirement, however due to <br /> the fact that only 8 percent of the development has the potential to be serviced by fire <br /> sprinkler suppression, the CITY is willing to waive the requirement in this case. <br /> <br />24. Mailbox Locations. The DEVELOPER herein agrees to cluster the mailboxes for the <br /> townhome development along the private streets where possible and placement of mailboxes <br /> along public streets is subject to the approval of the City. Utility locates Will be necessary. <br /> <br />24.
